It has been revealed that Mike Procter, the match referee who found Harbhajan Singh guilty of calling Andrew Symonds a “monkey” during the Sydney Test, relied on the evidence of four Australian players in reaching his decision.

In a leaked copy of his report on the hearing, Procter says: "I have heard evidence from Andrew Symonds, Michael Clarke and Mathew Hayden that he did say these words. Harbhajan Singh denies saying these words. Both umpires did not hear nor did Ricky Ponting or Sachin Tendulkar. I am satisfied and sure beyond reasonable doubt that Harbhajan Singh did say these words.

“I am satisfied that the words were said and that the complaint to the umpires, which forms this charge, would not have been put forward falsely, I dismiss any suggestion of motive or malice.”

Among those present at the hearing, held after the Sydney Test ended on January 6, was Sachin Tendulkar, the other Indian batsman at the crease. Procter says Tendulkar only “tried to calm things down” after the incident occurred.

“It was submitted to me by Chetan Chauhan [the Indian team manager] that there was doubt because the umpires and other players did not hear the words but, in my judgment, they would not have been in a position to hear them,” Procter says. “I note that Sachin Tendulkar only became involved when he realised that something was happening and was gestured over. He tried to calm things down because something had happened that he did not hear.”

The second issue he had to consider; Procter said, was whether Harbhajan used the words with the intention of insulting or offending him. **“I am sure beyond reasonable doubt that the use of the word “monkey” or “big monkey” was said to insult or offend Andrew Symonds on the basis of his race, colour or ethnic origin.” **

While asserting that whatever may have been said between them prior to the exchange in question was irrelevant, Procter acknowledges there was a “history” between the two dating back to the one-day international in Mumbai late last year. “It is not relevant to my findings here to decide what happened in Mumbai. Nevertheless there was trouble in Mumbai when members of the crowd were arrested for using the word “monkey” and gesturing towards Andrew Symonds. This caused both Indian and Australian boards to issue a joint-statement. To this extent Mumbai is relevant to this hearing.”

Honestly I don't have any doubt that harbhajjan did actually say the word "Monkey". Proctor had two witnesses in Clarke and Hayden to re-affirm that. He had no witness to refute except Bhajji himself. So Proctor in his conscience made the right decision. Like it or not, he had the balls to make the decision.

^ one of the lines in the document which Indian team received from Proctor after he banned Harbhajhan was "I believe that one group was telling the truth".

anyone can easily argue that how could Proctor said that he believed one group was telling the turth and assumed the other group as liars when there was no other group supporting Harbhjhan?

I don't care if Harbhajhan said it or not. The point is that there is not enough evidence. I think this is a simple case where harbhjhan should get away due to inconclusive evidence. Just because few Australians said something doesn't prove anything.

I dont remember the footage now but how come Bucknor didn't hear anything but Clarke and Hayden heard it????

lol that justification is worse than the decision itself

this is why Indian players and BCCI got upset
lot of people didn't understand why they wanted to pull out of tour, but its similiar when hair charged Pakistan with ball tampering without any evidence

gotta give kumble credit for getting the team together, glad dhoni or some kid was not captain or the whole thing could have ended up worse than it actually did

So any time a fielding time wants to get an opposing player banned just have 4-5 players accuse him of saying a racial taunt. The accused will deny it, but since there will be no evidence either way, the player will stand condemned. What a farce!

This is precisely the reason I am afraid of! Its a VERY dangerous precedent set by Procter and will result in further mudslinging and blame passing.

I recall that after Pak-Aus match in WC 2003, Gilchrist accused Rashid Latif that RL called him a 'white trash'. But there was not enough evidence to support the claim and hence Rashid was rightly exenorated.

What a farce, indeed!!

Well said, i've been with the Indian team since this whole saga started. Aussies are just being cry babies...as long as the umpire didnt hear anything, and the camera's didnt get anything..how the hell could just Ponting and Clarke get a player banned cuz they 'heard' Bhajji say Monkey. That is retarded.

Bhajji probably said something like* 'teri maan ki...'* in anger and Ponting and Clarke misheard it as 'monkey'
And if this is true then Gavaskar is vindicated
