Presidential immunity

Mr. Farhat ullah Babar the presidential spokesman has commented that President has immunity therefore will not be effected by the decision. Same are the views being expressed by Mr. Aitzaz Ahsan. It means like a top class besharam President instead of facing maasive and serious allegations against himself, is going to hide behind this immunity.

Our constitution guarantees us that there will be no law in our country against the principles of Islam. This immunity is clearly against the principles of Islam therefore the claimed immunity is agaist the spirit of constitution. I hope after historic decision on NRO, our SC decides against this immunity now!

Says govt will respect SC verdict

ISLAMABAD: The Presidency on Wednesday announced that the government accepts and respects the verdict of the Supreme Court.

“The president enjoys the immunity under Article 248(2) of the Constitution,” said Presidential spokesman Farhatullah Babar while talking to newsmen at the Supreme Court after the judgment of the apex court on the NRO.

He also ruled out the possibility of resignation by President Asif Ali Zardari when it questioned about the same. He read out Article 248(2) of the Constitution, which states, “No criminal proceedings whatsoever shall be instituted or continued against the president or a governor in any court during his term of office.”

Answering a question, the spokesman said none of these cases, which were framed against President Zardari 12 years back, were proved and the conviction given in one case was also overturned by the Supreme Court.

“The Supreme Court had not only overturned that conviction but also noted the bias of the trial judge,” he added. Babar said that neither the PPP nor its leaders were worried, as the party had been facing challenges in the past and would be ready to face the challenges in future as well. “The party will give its detailed reaction to the verdict once the detailed judgment of the Supreme Court comes. We will give our stance on it after the detailed judgment of the Supreme Court and after consultation within the party,” he added.

This is the best chance for Zardari and other innocents to prove themselves innocent, Zardari and co should resign and face the cases, if they are sure that they have not done anything wrong then this act will bring back the LOST credibility... and if ( like always) all have to be done by force, i.e., NROized ministers found guilty and then resigns will not earn any browny points to PPP...

Not many political parties are given these many chances, PPPP leadership and Jiyalas should know by now that they cannot fool around any more, they cannot play victim card anymore, If Zardari have served 11 years in Jails, then he should go to courts and ask for compensation for those years, he should sue the establishment and all those people who made false allegations against him, hence damaging his reputation and wasting tax-payers money...

Zardari have plenty moves left, but if he is going to listen to the likes of Rehman Malik and Salman Taseer, then i think this it shall be last nail in the coffin of PPP.

People of Pakistan are already fed-up with the politicians be it in the govt or opposition, they think that all are corrupt and these corrupt politicians are now scared to hell to face the cases against them... The logic that nothing has been proved in last 15-50 years does not make any sense... if Zardari want to make a history then this is his chance, it is his party which is in Govt. he can resign temporarily.. but one shall do this only if he is innocent, as then he knows their nothing wrong he have done..

On the other hand, if one has done corruption and the cases against him are right, then he should be scared, he should be cursing his stars and he should go down to use ethinic cards and show him as a victim ( of his own kartoots)

Let me be the devils advocate here. The accusations against Zardari are just that accusations. He has never been found guilty of any crime ever so why should he resign? Let the cases be proven in courts, and if he is found guilty of crime let him face impeachment, but until such time he should not resign.

I am not saying he should permanently resign, he should just take short-leave from the presidential office to clear all the cases and like i said earlier, if he is innocent then this is the golden time for him to get these cases dismissed once for ever...

This way, neither his Presidential status is going anywhere, because it is his party who have majority in Assemblies and it is them who are in the govt... this will bring back the LOST credibility.. thats all, no body says govt should go home now and there should be new elections.. they can replace the NROized ministers with the good ones and this will earn them lots of public support...

well strictly speaking, all the cases are not just accused or on going. swiss cases, they have been convicted by swiss courts already.

on the issues, its nice little game , you get the special treatment before you get elected without that one wouldnt have been a elected anyway. but once you become president, you are immunised :) people with no moral will not be deterred. I dont think Zardari will be resigning. would anybody? after resigning he will loose all immunity and may be straight to jail again! he wouldnt be signing his own warrants!

You mean he will again go to jail and this time under his own Govt???

Its about time that court take this up too while its busy in managing everyday business like who will work at which position in Govt .... Just yesterday court asked govt to post one officer (I dont remember his name) as a FIA director because he is a "honest officer".

So from now on court will post people in bureaucracy....... welcome to another extream ...

What are the goals actually ? and how NRO or no-NRO can affect these goals?

The goal is to get back all the looted/stolen money (reportedly Rs. 150 billion) from NRO criminals. No one wants to derail democracy. But people who have benefited from NRO and are now in cabinet (whether federal or provincial), MNAs, MPAs, senators etc. should be forced to resign or suspended till such time they get clearance from the courts against all NRO cases. One should not give criminals a free hand just because they are elected now

the goal is to build institution in Pakistan. Trust Zardari would get clean jit in next months from this same Supreme Court.

Pakistan’s Supreme Court today issued a contempt notice to Interior Minister Rehman Malik for “interfering” in a probe into alleged wrongdoing and financial irregularities in a state-owned steel company and summoned him to appear before it on December 24 to explain his actions.
An apex court bench headed by Chief Justice Iftikhar Chaudhry, which initiated suo motu proceedings after taking note of a media report of alleged corruption in the Pakistan Steel Mills, took exception to Malik’s decision to change the officer probing the matter.
The bench said the minister’s action amounted to interfering in the working of the judiciary.
It issued a contempt of court notice and summoned Malik to appear in court on December 24 to explain his actions.

Zardari is the president at the moment and has immunity, but one day he will complete his term as a president and wont have this immunity anymore, and that is when he will have to pay for his corruption/crimes. Altaf Hussein on the other hand, is as corrupt as Zardari and has British immunity which he will never have to give up and hence will never have to pay for his corruption/crimes.
