PML-N govt diverts IP pipeline funds to cover fiscal deficit

ISLAMABAD: The PML-N government has seemingly put the Iran-Pakistan (IP) gas pipeline project on the backburner by deciding to use the funds generated through the imposition of the Gas Infrastructure Development Cess (GIDC) to bridge the fiscal deficit.

The previous government had imposed the GIDC on gas consumers to generate the $1 billion needed to finance the construction of the IP gas pipeline, but the PML-N government is seeking discretionary powers from Parliament to raise gas prices through the cess, in order to bring them at par with prices of other alternate fuels.

Officials said the move may result in a massive rise in gas prices for all consumers except domestic consumers – including the CNG and fertiliser sectors and captive power plants – if the government decides to rationalise gas prices and bring them at par with other alternate fuels like petrol and furnace oil.

Sources said the petroleum ministry had approached the Council of Common Interests (CCI) to seek consent from the provinces to allow the federal government to introduce a new bill in parliament which will amend the GIDC Act, 2011. The amendments will allow the centre to use the GIDC as a fiscal tool in rationalising gas prices.

The PML-N government is seeking ex post facto approval for the GIDC Act, 2011 as a money bill. The move will provide legal cover to the previous government’s decision to impose the cess, while allowing the new government to keep the money recovered from gas consumers since the cess was imposed on January 1, 2012. Sources say that the collection so far amounts to Rs40 billion.

A court had earlier declared the GIDC illegal and ordered the government to pay back all money recovered from consumers under this head. The Islamabad High Court had declared the GIDC Act, 2011 as ultra vires to the constitution, mainly because it had been promulgated without due approval from the CCI. However, the new government will work its way around that complication and keep charging the cess from consumers by legalising the GIDC and securing an ex post facto approval from the CCI.

The Oil and Gas Regulatory Authority currently is the only authority that can fix gas prices, and the federal government is obliged to follow its decisions in this regard.
The government also plans to take the provinces onboard, seeking an ex post facto approval from them to amend the second schedule of the GIDC Act, as was done through the Finance Act, 2012, in order to provide flexibility to the federal government to revise the rates of the cess subject to a maximum limit.

This pipeline will be brought to life again near next elections. How come they didnt delay the metro bus and/or some other dev. projects instead of this one? unless its a pipe dream.

Noon League has been indicating its disinterest in the IP pipeline project from the day one. But given the lukewarm Saudi treatment to the Sharif government, I think the pipeline window will not be shut entirely, at least for the time being. While Sharif will go ahead with Gawadar Port deal with China, he may try to use the IP pipeline issue as a bargaining chip with the Saudis and the Americans.

Another interesting development is Sharif's offer to China to extend the pipeline towards Chinese border. On the other side, Russia is also keen to be a part of the pipeline project as an investor. I think if China and Russia show their interest in the pipeline, it will emerge as a 'nexus of evil' type block against the interest of Uncle Sam. India may also jump the bandwagon if China and Russia formally join the pipeline.

If this is true, this will be most stupid decision NS has taken. This decision will cause him lots of sufferings and pain, not only to people who were looking for energy demand but also by the leaders of Iran who will never trust paki leaders in the future. To me it looks like bargain with IMF.

Though China is bargaining and getting oil from Iran, for which it is exempted from US sanctions like India, I don't think that they have a desire to engage in gas pipelines considering that they are quitely siphoning away the gas from the huge central asian reserves. The rest is being diverted by Russia to blackmail Europe, which is why Gazprom has such an interest in IP or IPI pipeline. Russia is a spent power and it knows that it can only blackmail Europe on resources, since it can't challenge the military imbalance in Europe let alone take on the US.

The worst part in all this is that pakistan still couldn't manage to get a firm deal on the price of the gas i.e. it is pegged to current price of crude in the world. We can't even pay the thermal plants, so how does Pakistan plan to subsidize the expensive gas when subsiding the cheaper sui gas is a fiscal problem for the govt? I'd give it to Zardari's politics to ink the deal at the end of PPP's tenure. He knew that PPP ain't coming back and he won't be the president after this year barring some miracle. I can see how PPP could use this issue in the next election to even come back in power so kudos there.
