oh pls yar…this word is so over used by our great leader its starting to irritate me. Why must everything be about national security. How abt personal security for a change. I suppose that term only applies to musharraf with his cavalcade of bullet proof Mercedes with electronic dooh dahs…with my tax money. People like justice Iftikhar should burn in hell if they desire a protocol beyond a measly 1600cc car. :rolleyes:

CJ proves hard nut to crack

ISLAMABAD: Long-drawn-out persuasion by the top brass of Pakistan’s elite intelligence agencies and high-ranking officials failed to convince a resolute chief justice Iftikhar Muhammad Chaudhry to step down before a presidential reference was filed against him.

He stood like a rock, ready to face the challenge, in the hours-long persuasive sessions. A family source close to the “non-functional” chief justice quoted Justice Chaudhry as saying that during the critical Friday meeting with the president, he was given two options by General Pervez Musharraf — resign or face the reference.

“I opted not to succumb,” the source quoted him as telling the tale of his five-hour stay in the Army House on Friday. After the suspended chief justice told the president that he would never step down, the source revealed that almost 18 officials, including the top brass of the intelligence agencies, kept on swaying him, one after the other, to avail the first option, but he chose the hard one.

He, however, made it clear that he was not mistreated at any stage of the extended sessions. He was also offered lunch. He told his friends and acquaintances, who were able to meet him before the present security cordon around his official residence was clamped by the government, that he had immediately made up his mind that he would not bow out.

The source, who is still in contact with the chief justice and his family because of a not yet tracked communication means, said Justice Chaudhry had also told his sympathisers that the “charge sheet” read by the president was the replica of the much-condemned open letter of a Supreme Court lawyer, who, it is generally believed, was written as a precursor to the reference.

After an almost five-hour stay in the Army House and following his consistent refusal to quit, he was allowed to go. One obvious change he immediately noticed as soon as he came to board his staff car was the missing of the chief justice’s flag from his official limousine. Acting Chief Justice Javed Iqbal took the oath of his office at a time when the chief justice was in the Army House.

When Justice Chaudhry came back, the world had changed for him altogether. Although the government claims that the suspended chief justice is not under house arrest, within hours of his return from the Army House, the top judge’s official residence was cordoned off, the telephone lines were disconnected and even the available mobile phones were taken away. The television cable was working till Saturday morning, but it was also cut off later.

The suspended chief justice was also not provided with newspapers although he was getting the crux of the media coverage on his issue through a lone communication mean that is still breathing. Except those allowed to meet him on Sunday as has happened in selected cases, no one can get in or out.

“It’s a pity that the man who spent all his life in delivering justice to people is now himself in need of justice," the source said, adding that the suspended chief justice is treated in a manner as if he were involved in some major corruption case. “But Justice Iftikhar’s track record speaks of his financial integrity,” the source said, adding that “Pakistan is not the property of a few in power; this is our country.”

The source said the only hope left is the media that should raise its voice for justice and it is certain that the people of conscience will come forward and do their maximum to stop this injustice.


Even if half of this is true, I salute the guy. In the heart of my hearts though, I dont see him coming back. Pretty sad.

In this heightened interlude, the contents of the presidential reference against Justice Chaudhry are a mystery as these have been put under wraps. The government is exceedingly aggressive in not making them public. One important reason for not publicising its details is that it may annoy the SJC members, which the government does not want at this crucial stage

Tuesday will be a planned siege of the Supreme Court, where the SJC will hold what has been rightly termed a “trial by the peers,” to be laid by hundreds of fuming lawyers. The atmosphere inside and outside the apex court would be filled with angst and tension

It will be a unique prosecution – first condemned then tried. The legal community has questioned it across the board. Justice Chaudhry has turned out to be the first chief justice of Pakistan who has been put in the dock this way. But he has stood his ground.

"The rules framed by Justice Cornelius in 1970, which were later validated by parliament during the 1970s, provide that a superior court judge, facing a reference in the SJC, can be sent on compulsory leave,” eminent lawyer Justice (retd) Malik Qayyum told The News from Lahore by phone.

He said the “suspension” of Justice Chaudhry was the result of ill advice. And those who counselled so did not know the law and it was a conspiracy against General Pervez Musharraf to trap him in a quagmire, he said, adding that “suspension” or “making the judge non-functional or ineffective” is alien to the Constitution, law and rules.

The first major question, agitating many minds, is that why was an acting chief justice sworn in in the presence of the “suspended, non-functional” chief justice. The senior most judge was to become acting chief justice (if at all such an appointment was required in the given situation), which was not done and so much haste was shown that the arrival of Justice Rana Baghwandas from abroad was not awaited.

When he returns to Pakistan in the beginning of the last week of the current month, he is to be the permanent or acting chief justice in order of seniority. But the government may not like to have him in this top slot. Baghwandash may quit if he was not named permanent chief justice.

The SJC will itself be under immense pressure because fingers have been pointed at some of its members for their various actions. Pakistan’s lawyers, including their representative forums, had never demonstrated such unprecedented unity among their ranks against an official action as they have done now. Their apex body is poised to become a party to the reference, a plea that is unlikely to be accepted. This will further fuel the protest.

Besides their efforts to fight Justice Chaudhry’s case, the lawyers community has brought the court business to a grinding halt because of their boycott. They have taken the lead over politicians, who are also protesting against the strike.

Apart from multitudes of others, who are grieved over the action against Justice Chaudhry, the relatives of the mysteriously disappeared persons are also anguished. They had got considerable relief from the Supreme Court headed by Justice Chaudhry

I am not sure what all the fuss is about?

Just like the chaos caused by the rains in Karachi in the past few days, this episode of the removal of CJ will be forgotten in a few weeks.

I certainly hope so - there are more important decisions to be made by General Musharaf in the coming weeks, such as, supporting the US and providing logistical support the US forces when they decide to attack Iran.

If Pakistan can survive the wrath of the world for what AQ Khan had done regarding proliferation, then they can survive anything. The suspension of CJ is just an inconvenience in the longer term plans of what needs to be achieved by General Musharaf in fight against terror.

The quicker this little inconvenience passes the better it is for Pakistan, and the fight against terror for which General Musharaf is an integral part.

There was this article on BBC about a por villager from Sindh, Manno Bheel, whose family members had been abducted by a politician. His case was also taken up by CJ bu sou moto notice. On news of his suspension, Manno Bheel remarked,

"Pehlo to case ki tafteesh kerney waley afsar ko tabdeel kiya jata tha, is dafa judge ko tabdeel ker diya gaya"

(Earlier, the investigating police officer used to be transferred, this time around the judge has been changed.)

Justice (r) Fakhruddin Jee Ibrahim has refused to counsel government in this case.

That's why I'm asking you to name just one non terrorist that has disappeared, and you cannot! Security threats should be dealt with like this. They should all be given a fair trial though. But if they need locking up in the meantime then that's understabable, so long as it can be justified.

SO FIND ME JUST ONE PERSON WHO'S A POLITICAL ACTIVIST THAT HAS BEEN DETAINED!

If Musharraf was going to detain activists, why doesnt he silence the media? Because the media is the biggest factor to establishing state control. Silencing one or two political activists might be able to stop one or two articles being written, but so long as whole papers are anti government, this will not make a blind bit of difference since there are thousands of other anti government articles.

The only thing I dont understand is why (or how) can people be so slow?

saleem, once i opened up the post i thought at least this will be a one sided post where any logical mind would oppose this baseless and stupid approach by our president, but alas it is not the case.

Army chief using two houses right now, Army house and President House. He has not vacated the Army house for the vice chief which he should have done.

Army chief is lesser in rank than Chief Justice but he goes every where on his own Cessena Citation or Military Helicopter. While chief justice cannot travel in government plane. frivolous.

Army chief can have two big houses called Army Guest House in Lahore & Karachi but chief Justice cannot keep a wing reserved for him though senior in rank. frivolous.

President cannot suspend a chief Justice, there is no mention in Article 209 that after or before filing the reference you suspend him as well or ineffective a term no existing in constitution.

That son of the ***** meer Jaffer type Justice Javed Iqbal will now recommend to Musharraf that his acts had been contrary to constitution and he is no longer eligible for the post and Musharraf will willingly oblige.

I suppose he will be happy, he got the backing from the one he really is accountable to. To hell with Pakistan and its people. To date I only thought Blair was Bush’s poodle, seems like Bush likes poodles and have a number of them around the world.
