LAHORE: The Punjab Bar Council (PbBC) cancelled Advocate Naeem Bokhari’s practicing licence on Saturday and banned his entry to any bar association of the province for levelling allegations against suspended Chief Justice Iftikhar Muhammad Chaudhry. Naeem Bokhari, also a famous television personality, wrote an open letter to Justice Iftikhar Mohammad Chaudhry on February 17 accusing him of failing in his duties as chief justice of the Supreme Court. The letter, which was widely circulated in Punjab official and social circles, accused him of using his office to favour his son, of being excessively fond of protocol, and of being rude to lawyers.
Actually the president cannot suspend or remove a judge from his office unless he is found culpable by the SJC. And here the president has suspended a judge before any kind of inquiry was requested or conducted...
To fire someone means to dismiss or sack that person (not suspend that person). CJ is not fired but suspended.
If the editor of this news paper do not know the meaning of word suspension and translate it as firing (or intentionally wrote to misguide the readers), could anyone trust such newspaper or the editor of that newspaper?
Thus, I can only say that whole article where the writer does not know English and still using English to write, could be nothing, but crap. If the writer of the article knows English, his wrong reporting that ‘Musharraf fired CJ’ shows that the writer is just propagandist and liar and thus cannot be trusted for any thing that a person waste time to read the article of a liar Whatever he wrote is propaganda and misinformation.
QUETTA, March 10: Advocate Aamir Rana, a close relative of Justice Iftikhar Chaudhry, has claimed that the government was putting pressure on the chief justice to resign from his post.
“Authorities concerned are demanding resignation from the chief justice,” Mr Rana told BBC on Saturday in an interview by telephone.
However, after the interview he went into hiding as he informed a lawyer that some people in ‘plain cloths’ raided his house to arrest him.
“I am safe and sound,” he informed one of his fellows through a massage, adding that the government wanted to arrest him. When contacted, Mr Rana’s cellphone was found switched off while nobody was attending his residence telephone.
Mr Rana, who is nephew of Justice Chaudhry’s wife, told the BBC that the movement of the chief justice had been restricted to his official residence in Islamabad. “No close relatives are allowed to meet him,” he said, adding that all telephones of the official residence had been disconnected.
Mr Rana claimed that President Musharraf asked Justice Chaudhry not to pass remarks against the government during the hearing of different cases. According to him, Justice Chaudhry was facing a lot of pressure from the government to dismiss cases of missing persons.

After the recommendation of SJC, suspension would become meaningless. CJ would stay as CJ or get removed. Suspension can only happen before enquiry, how can it happen after enquiry? Please elaborate how suspension can happen after enquiry? :D
Actually suspension is a process that only happens when a person is under enquiry. Suspension can also happen for other things, like experiment or construction work, and again that happens if enquiry starts regarding that experiment or work.

A judge cannot be suspended before the inquiry and can be removed only after the inquiry is conducted.

Where does it say that a judge cannot be suspended before inquiry? Show me anywhere in constitution that says that there could be no suspension before enquiry. If enquiry of a judge can happen, suspension is automatic (unless that suspension could harm the working of the system and suspension of CJ could not harm the working of the system, as there is acting CJ appointed).
So, if suspension is not automatic prior to the enquiry, there must be mentioned somewhere in constitution that a judge should not be suspended while under enquiry. So, please quote that part of constitution as what I know, constitution says nothing about that.
[Actually, if enquiry can happen, suspension is necessary else that enquiry would be meaningless and it would mean that law makers were idiot to enact such law in the constitution]

Saleem, show me where it is mentioned in the constitution that the president can suspend a judge...
I think now time has come for the lovers of 209 clause to read also clause 6 which states when anyone throw off an elected government..sentence him to death .....if General is so much concern about constitution .....so he should also act on clause 6 .....

And I'm not a constitutional expert. Numerous articles and editorials have been printed in different newspapers regarding this matter in the lat few days, read them to find the truth...
the only sin of this bravest judge of Pakistan history is that he refused to bow down in front of "khakis " and "boots" and this "sin" is unbeareable !!!!......

Overall on the issue, I'm too surprised shocked and confused...still couldnt find words to describe the scenario...
In any case, such a scenario was something we really really didnt need. Pakistan can hardly afford such miserable political accidents at this stage...pathetic conditions...
Saleem, show me where it is mentioned in the constitution that the president can suspend a judge...
How can he show you something that is not in the constitution? He knows he's wrong, but he will never admit it even if every constitutional expert in Pakistan says otherwise. Only if the army says so, he will admit it.
