in prior history had govt filed references against supreme court judges? if so when, and where, what was the outcome etc?

Justice Ramday, who heads the Supreme Court bench, also observed that all but one of the four references previously filed against judges of the superior courts came under military regimes, and in the one instance where charges were filed under a civilian regime, the accused judge was exonerated, the Daily Times reported.

Justice Ramday made the observation after Pirzada gave an overview of the record of references filed against judges in Pakistan.

Pirzada had earlier stated the first reference was filed against Justice Hasan Ali Agha in 1951, the second against Justice Ikhlaq Hussain, the third against Justice Shaikh Shaukat Ali and the fourth against Justice Safdar Ali Shah.

To which Justice Ramday said, “Justice Ikhlaq had to face the reference in the Ayub regime; Justice Shaukat Ali in the Yahya regime and Justice Safdar Ali Shah in the Zia regime. I don’t know whether these cases will be helpful in adjudication of the present reference or not.”

Mr Pirzada referred to four references filed against Justice Ali Hasan Agha in 1951, Justice Iklaque Hussain during the Gen Ayub Khan period in 1960, Justice Shaukat Ali and Justice Fazal Ghani during the Gen Yahya Khan tenure in 1969 and against Justice Safdar Ali Shah during the Gen Ziaul Haq period.

Only Justice Ali Hasan Agha was exonerated from the charges of misconduct, Justice Ikhlaque Hussain was removed and other judges resigned, he said.

At this, Justice Ramday observed that the common factor in the three references in which the judges were either removed or resigned was that these were filed during the martial period and the one in which the judge was exonerated was moved during a civilian government.

On Wednesday, Syed Sharifuddin Pirzada, giving an overview of the judicial history of the country with regards to references filed against honourable judges, argued against the maintainability of the constitutional petition of Justice Iftikhar Muhammad Chaudhry.

He said the first reference in the judicial history of the country was filed against Justice Hasan Ali Agha in the Federal Court of Pakistan during 1951; the second reference was against Justice Ikhlaq Hussain and the third against Justice Shaukat Ali while the fourth one was filed against Justice Safdar Ali Shah. All these references led to clashes between respondents and the prosecutors, he said.

Justice Khalilur Rahman Ramday, however, observed that all these references were filed during the martial law regimes except the one against Justice Hasan Ali Agha that was filed in a civilian regime and he was exonerated of all charges in 1951.

The reference against Justice Ikhlaq was made out in Ayub’s regime; Justice Shaikh Shaukat Ali faced reference in General Yahya’s regime and Justice Safdar Ali Shah in General Zia’s regime. He said all these cases were made out in peculiar circumstances and were settled on different grounds. “I don’t know whether these cases would be helpful in the adjudication of the present reference or not,” said Justice Khalilur Rahman Ramday.

He also added that Justice Shaikh Shaukat was removed on the basis of the reference but the decision of his removal remained controversial and later Justice Shaikh Shaukat was also elected president of the bar.

but a man who can punch into Establishment into steel mill case..lost people cases...basant..gwadar port case...what can you expect from him ...that he would "yarak" jai ga when dictatoir in wardi will ask resignation from him !!!!!!!!!
