Options?

husband recently moved here from canada, deciding to apply for immigration.

We’ve been told the process should take at least 3 months (or longer). At the advice of a few people, he’s started applying for jobs right away despite knowing that w/o any work authorization it will be useless. So he’s applied for FT, contract based and corp to corp jobs and is actually getting alot of emails and calls. He meets almost all their requirements (in some cases all) except for that darn SSN#.

The same few ppl keep advising him that when asked, he should just give a false SSN. Now..we are under the impression that this is illegal or at least not right, and will cause us more problems than benefits, if not now than in the long run and we dont want to go down that route. But at the same time he doesnt want to be sitting here for a few months doing nothing, as its unhealthy for the mind, body and soul(bank account). :halo:

Basically he cannot get a job in his field until he gets his authorization, and that itsself might take God knows how long.. So exactly what are his options during this waiting period? PS He tried looking for jobs thatll pay cash only but u have ot know people…which we don’t…and the one he did get, well that wasn’t a good idea by any means… so what are his options during this waiting period?

what i knew was that if a canadian national immigrate to u.s whether or not he has u.s visa or citizenship , could work here using his TN visa( as a work permit?) , correct me if i'm wrong

Giving out false SS # is a bad bad idea ..

can he try jobs that allow to work from home, no matter where the home is. There are many people who work for American Company but do it from off shore.

Is he a Canadian citizen ? If he is he can work on TN visa as hsap said above. If he is not a Canadian citizen then yes he will need work permit which does not take 120 days , 120 days is max period EAD ( Employment Authorization Document ) should be sent to him after 120 days are over and if he still does not get it he can go to nearest immigration office and show the reciept of EAD application and get a temporary EAD which is valid for 120 days in the mean time he will get his one year EAD.

Sara... isn't he a Canadian citizen though? he can certainly work on a TN visa then. The only requirement is that he have a Bachelor's degree and he belong to one of the professional categories outlined in the TN visa requirements.

There are several online toolkits available that you can use to manage your own application but consulting with an immigration firm always helps and reduces your own headache.

I've personally worked in the States on a temporary TN visa. Also I've worked through an arrangement where I render my services as a consultant through a business concern that I've registered in Canada for this purpose. That way, I can work as a contractor. It really depends on what your employer/client wants in terms of managing their payroll and project budgets.

thanx for the quick replies. i came here as a tourist and the whole idea of staying here and getting immigration started here. from wht i know, for TN visa i need a job letter for a company which i don't have but can get. but don't i have to go back to canada and then reenter US and get the TN visa there? atleast thats the only way i'm aware of and with my immigration application in process, i cannot leave the country since i applied from within US and not abroad and to travel out of US i need travel document which is not yet given to me. for now all i've got from immigration and citizenship department are receipts related to payments and them receiving my application. so how can i apply for an EAD bcos where ever i apply and call they always ask about my status in US and i always tell them then currenctly i'm going through immigration process and thus have no status or EAD.

all i want to know is what are my options other than the obvious ones which are not very helpful for now. i can't just sit and do nothing.

Yeah but that would abandon the adjustment of status... USCIS has strict rules.

and yes, dont work without a SS number or a fake one! it can get u into a lot of trouble as when you apply for adjustment of status they do pull up your employment records. These days they can easily verify SSns using a new system called E-verify

yeah your situation does complicate things a little saieen.

Ideally, you should have visited the U.S. for job searching purposes... secured employment and gotten your TN visa - and then filed your immigration papers after moving in.

That's what another friend of mine did recently.

Again, I would advise talking to an immigration consultant and they might be able to advise you better.

When your immigration application is filed a form I-765 is filed with it which is application for employment authorization , you do not have to be immigrant yet to apply for that . that application is specifically for those people who are in US and have applied for immigration.

i see

-what i knew is EAD takes time , so is immigration process , as u get EAD @ very end of it.
-how about if u apply for an online job (to work from u.s) in canada ?? (not to get a TN but to get a job right away) u might have to travel back for that, so wait for travel document which might not take that long
- work on more than just one option , and go for which ever works first

i knew little about that all as we've applied for canadian immi sometime back and came across various facts if in case we've to move back to u.s after getting canadian citizenship

However what lucid said was the correct route. You cant leave the country (without abandoning ur pending adjustment status), without the travel documents. These days they are taking a long time to issue/renew EADs and travel documents, based on what I heard from a friend because of an upsurge of applications since last year.

can't apply for TN visa bcos its for non immigrants only and my immigration application is already in process :-/

Did you file I-130 or I-485 or both together ?

wohi tow keh rahey heiN yaar... you should have secured employment... applied for a TN visa... moved to the US and then filed your immgiration papers.

Yeah, i just checked, right now USCIS Nebraska is processing applications submitted before May 01, 2008, so it's gonna take a long time.

i never came to US with the intent of staying here and making a living. all this mambo jambo started later. verna kuch to kerta hi anay se pehaly.
