ISLAMABAD: Supreme Court Chief Justice Iftikhar Mohammed Chaudhry said on Wednesday that if Prime Minister Syed Yousuf Raza Gilani did not want implementation of courts orders, other options including imposition of emergency were available in the Constitution.

He made this remark while hearing the case of missing persons and law and order situation in Balochistan in the Quetta registry of the court.

Irked by the absence of the Balochistan Home Minister Mir Nasirullah Zehri, Justice Chaudhry ordered the interior secretary to register a case against him, adding that if Zehri did not want to appear before the court he should be arrested and brought before it.

Defence Secretary Narjis Sethi, Gilani’s principal secretary Khushnood Akhtar Lashari, Balochistan Chief Secretary and other top officials appeared before the court.

The chief justice remarked that the government is not following Article 148 of the Constitution despite repeated reminders.

People are blaming Inter-Services Intelligence (ISI), Military Intelligence (MI), Frontier Corps (FC) and other law enforcement agencies (LEAs), he said. Target killings are rampant in Balochistan and police is helpless but no one is giving answers.

He said the apex court can give up all important assignments to resolve Balochistan issue.


I hope he does not go to that length or Zardari will immediately come out waving his ‘shahadat card’. It would be an ideal situation for the PPP.

^ isn't that trait of all PPP leaders? Whenever a crisis takes place they run out of country for "pre-scheduled" visit which for some reason can not be cancelled.

CJ have nothing to do with emergency, neither he have any powers as such. There are only two ways of declaring emergency according to Constitution:

1) Provincial Assembly pass a resolution asking Federal government to impose emergency.

2) President on the advise of PM (after 18 amendment), in this case President have to get authorization in 10 days from both houses of Parliament & Senate

now can you care to explain what the freak CJ said, i will take it as the comments are not correctly reported.
Secondly CJ keep calling Yousaf Gillani as Prime Minister again n again, so it mean CJ still think he is Prime Minister?

It's a news thread as reported by the media. There was no word of mouth from the CJ that I heard myself. Just as you are reporting here Kaira's press conference. So we don't really know if the SC has got any power to take such step. If there is no provision in the constitution to do so, it won't be done and it should not be. I won't support any act by anyone, including SC, if it is not allowed by the statute.

Mr. Gilani has right to appeal which he will be doing shortly. And until he exhausts all of his legal privileges as a defendant, he shall continue to be legitimate in his position. In a way, he is a prime minister on stay. Since Mr. Gilani was sentenced only by a seven-member bench, the final outcome of his case will be decided on an intra-court appeal before a larger bench headed by none other than the chief justice himself. Till then, he is very much on.

nope i am not reporting Kaira press conference here. How to declare emergency is very clear in Constitution and Sir's CJ just can't made up everything from his arse. Its a very delicate fine line.
I have serious doubts on CJ handling of missing person case, he didn't bother to call a single Khaki-uniform person. Who the hell is FC head a serving Major General, call his ass in the court tomorrow for public hearing, but well that is too much to ask for.

According to this news IGFC appeared in the court in that case, but you need to understand that the courts cannot force someone to appear in front of them (even the secretaries of the government are not appearing in front of them). The government has no interest in the province and the military is not cooperating so what do you expect from the courts? In the present situation they are doing a good job.

what is this a joke? if it's already confirm FC is involve that's the best CJ can advise to mighty Major General. Why not order to arrest him on the spot?

If he orders to arrest him who will do that, who is the police And army under? Like I mentioned neither the government nor the military is cooperating in this case, so what do you expect. Any ruling that the court will give the government will set aside, keeping in view all the odds the court is doing more than the other two departments.

If he can not do the real work of CJ, he should resign. Corrupt judges of supreme court are members of notorious Palm Club which CJ himself and other involved judges are sitting on judgement for the last one year. He is throwing stones on to PPP government, kabhi apnay graibann main jhank kar dekha hay ke kar kya raha hay!

He is product of dictatorship and continued his post of CJ while taking oath under PCO. What can you expect from the illegetimate progeny of dictatorship? Shame on him for uttering this nonse. I think he should retire from this position to avoid further insult to highest post of judiciary in Pakistan.
