After being threatened with having his membership of the Peshawar High Court Bar Association (PHCBA) cancelled, lawyer Mohibullah Kakakhel did not submit a writ petition on behalf of opposition members of the NWFP Assembly against the assembly dissolution at the Peshawar High Court (PHC). Kakakhel on Monday completed the submission process at the writ branch in the presence of petitioner MPAs - Nighat Yasmeen Orakzai and Saeed Khan. The petitioners and their lawyer first went to the office of the PHC registrar and verified the writ petition, after which they came to the PHC deputy registrar’s office for signatures amid a crowd of media personnel. They then came out of the writ branch and told reporters that they had submitted the petition in the writ branch.
On Tuesday morning, many people, including lawyers, gathered on the PHC premises for the writ petition hearing, but returned disappointed when they were informed that Kakakhel had not submitted the writ petition. Fear of backlash:** “My boss asked me not to submit the writ petition as the legal fraternity may attack us,” Wahidullah, an assistant to Advocate Mohibullah Kakakhel, told Daily Times. “We completed the whole process but avoided submitting the petition in the wake of lawyers’ warnings threatening suspension of Kakakhel’s membership,”** he added. PHC Registrar Musaddiq Hussain Gillani told Daily Times that they had not received any writ petition from the opposition MPAs. “We would have forwarded the petition for a hearing had we received it,” he said
