NWFP lawyers slam APDM for delaying dissolution advice

The lawyers’ community on Monday resolved not to allow any MPA to cast their vote in the presidential election on October 6. The lawyers observed a black day and boycotted court proceedings in protest against the use of brute force by police against lawyers and journalists in Islamabad and other cities. A joint general body meeting of the Peshawar High Court Bar Association and the Peshawar District Bar Association criticised the Muttahida Majlis-i-Amal for delaying the advice by the chief minister to the governor for dissolution of the NWFP assembly. The meeting was followed by a protest demonstration.
Black flags were hoisted at various points in the high court, judicial complex and session court.

PDBA president Maulana Shamsul Haq said that due to the delay in the advice the pro-Musharraf parties got opportunity to submit a no-confidence resolution in the assembly after which the chief minister could not tender the advice to the governor. NWFP vice-president of Muslim League Lawyers Wing Pir Buksh Mehtab, announced quitting his organisation in protest against the treatment meted out to lawyers and journalists in Islamabad and other cities. He said that in present situation he could not continue with the Muslim Lawyers Forum. **PHCBA president Lateef Afridi said that they had already decided to besiege the NWFP assembly and not to let any MPA to cast the vote on Oct 6. **He said that the lawyers movement would culminate with their victory against a military ruler. PHCBA secretary-general Ishtiaq Ibraheem, Barrister Baachha, Kareem Mehsud, Abbas Sangeen, Nek Nawaz Khan, Ghulam Nabi, Qaiser Rasheed, Pir Buksh Mehtab, Hazrat Said, Naveed Akhter and S.N.Sabir also spoke on the occasion. They criticised the All Parties Democratic Alliance for delaying the advice for dissolution of the NWFP Assembly. They said that the pro-Musharraf groups were provided enough time to chalk out strategy for pre-empting the move. They said that Gen Musharraf had been using all tactics to fizzle out the lawyers movement and due to same reason the lawyers were severely tortured and beaten in Islamabad. They said that with such tactics their movement could not be stopped.

The opposition has just formally tabled a no confidence resolution in the NWFP government, and the earliest that can be voted on the afternoon of 6th October. If the MMA govt wins that it can then move to request for dissolution, which will only take effect on 8th October. So NWFP assembly will be very much in place on the day of the Presidential Election on the 6th, and no resignations from anyone. Maulana Diesel has pulled another fast one on his opposition colleagues. :hehe:

As per BBC, voting will be held on the no confidence motion on 8th and that is 2 days after Presidential Elections :jhanda:

The opposition members in the NWFP Assembly Wednesday succeeded to avoid the possible dissolution of the assembly after it went through a rumpus as the chair fixed October 8 next for voting on no trust motion against the Chief Minister. MMA members were chanting slogans “Go Musharraf Go” and PML(Q) members were chanting slogans “Doo Esteefay Doo” (Give Resignation) :smiley:

So now MMA can not accuse Mush of breaking his promise as they broke the promise of resignation. They did that promise in front of 10 coroor aawam just like Mush did about his wardee :slight_smile:

After being threatened with having his membership of the Peshawar High Court Bar Association (PHCBA) cancelled, lawyer Mohibullah Kakakhel did not submit a writ petition on behalf of opposition members of the NWFP Assembly against the assembly dissolution at the Peshawar High Court (PHC). Kakakhel on Monday completed the submission process at the writ branch in the presence of petitioner MPAs - Nighat Yasmeen Orakzai and Saeed Khan. The petitioners and their lawyer first went to the office of the PHC registrar and verified the writ petition, after which they came to the PHC deputy registrar’s office for signatures amid a crowd of media personnel. They then came out of the writ branch and told reporters that they had submitted the petition in the writ branch.

On Tuesday morning, many people, including lawyers, gathered on the PHC premises for the writ petition hearing, but returned disappointed when they were informed that Kakakhel had not submitted the writ petition. Fear of backlash:** “My boss asked me not to submit the writ petition as the legal fraternity may attack us,” Wahidullah, an assistant to Advocate Mohibullah Kakakhel, told Daily Times. “We completed the whole process but avoided submitting the petition in the wake of lawyers’ warnings threatening suspension of Kakakhel’s membership,”** he added. PHC Registrar Musaddiq Hussain Gillani told Daily Times that they had not received any writ petition from the opposition MPAs. “We would have forwarded the petition for a hearing had we received it,” he said

In another twist, APDM has resigned from NWFP assembly but only JUI have decided not to resign. JAMAT-E-ISLAMI, PML(N) and ANP presented their resignations to speaker of the assembly while JUI has decided not to resign before the voting on non-confidence motion.

Due to the resignation of JAMAT-E-ISLAMI, JUI now don't have the majority in the assembly and when CM is going to ask for the dissolution of assembly, Governor can ask him to show his majority according to the **article-130 of constitution**
