SC moved for suo moto action against Ordinance
ISLAMABAD (NNI) - A petition was filed in the Supreme Court on Monday requesting the court to take suo motu action against National Reconciliation Ordinance 2007 as it was against the fundamental rights of the people of Pakistan. Insaaf Welfare Trust filed the petition through its Chairman Dr. Aslam Khaki. Federation of Pakistan, President of Pakistan, Pakistan Peoples Party through its Chairman Benazir Bhutto, PPPP through Aftab Khan Sherpao and MQM through Farooq Sattar have been made respondents in the petition. The petition said that National Reconciliation Ordinance 2007 was abuse of authority and be declared unjust. The petition said the impugned ordinance is against the provisions as envisaged in the Constitution of Pakistan. “That the impugned ordinance provides for general amnesty for the corrupt politicians and bureaucrats which is in fact a punishment to the poor nation of Pakistan”, said the petition. Dr. Aslam Khaki in his petition also requested the court to stay and suspend the impugned ordinance

Thats good, and will test how impartial SC is now and should act in broader benefit of People of Pakistan not People of Pakistan Peoples Party and other looters and also not immute the future looters for wrong doing!
I want to see how BB respond to courts when that judge against her! she will brand them again as "Kangroo Courts"

Three wheels of Pakistan governance are syncronized now. SC will not dare to derail the process. Unless Pakis stand up jointly against this arrangement and come out on streets possibility of which is very remote.

In her ongoing talks with the govt side, BB has proposed limiting a CJ's term to just 30 months, and also cutting the courts powers. Wisely the govt side which believes in a free judiciary has rejected those suggestions.

Actually, wouldn’t it be fun just to watch the reaction of nay sayers if Musharaf was to leave and leaders like BB and NS took over. We will soon find out how much of Free Media and Free Judiciary they will have. ![]()

Next parliament to approve NRO

ISLAMABAD: The ruling coalition is going to leave the enactment of the controversial National Reconciliation Ordinance (NRO) into law to the next parliament. “I don’t think the government seriously wants to get the NRO approved from the present legislature,” a senior official told The News. It was widely believed that the NRO would be tabled in the National Assembly in its session that was apparently convened for this very purpose. But it wasn’t, and the session was briefly held on Saturday and Tuesday before being prorogued sine die. Under the Constitution, it is required to put all ordinances, which had been promulgated when the National Assembly was not in session, before it on the first day of its new sitting. After the brief Lower House session was over, Parliamentary Affairs Minister Sher Afgan, contacted by The News, said that he has asked his staff to place the NRO in the National Assembly library, which would be deemed as if it was presented to the House during its session.
He said the NRO had not been printed in the form of a bill, enabling him to table it in the National Assembly on Tuesday, which caused delay. The minister said an ordinance can be laid before either House of parliament in two ways — it can be moved in the House or even if it is placed in the National Assembly library, it is deemed to have been presented in the House. For now, it is all milk and honey for the government in the National Assembly with the opposition MPs having quit. The Pakistan People’s Party Parliamentarians (PPPP), which did not resign from the Lower House or provincial assemblies to provide legitimacy to the October 6 presidential election, and in return got the NRO, is no more regarded as an opposition force. Now the PPP and the government are hand in glove. Given the present composition of the Lower House, it can pass the NRO, how despicable and discriminatory it is, within minutes. However, the scenario will certainly be different in the Senate because the opposition still stays in it. But the government, naturally supported by the PPPP, a major beneficiary of the NRO, can easily pass it in the Senate as well.
If the government were serious in securing approval of the parliament for the NRO at an early date, it would have promptly moved the proposed legislation in the National Assembly in its just ended two-day session. A presidential ordinance has 120 days constitutional life in the first go but it can be repeatedly extended for the same length of time before the expiration of each period. However, the government can revoke an ordinance any time. The Parliament can also reject such instant law or pass it as it is or with amendments.

Musharraf to honour ‘deal’ even without NRO

ISLAMABAD: President Musharraf is said to have given a firm assurance to international guarantors that he will honour the deal with Benazir Bhutto in case of court intervention against the National Reconciliation Ordinance (NRO), adding that he will protect the interests of the exiled leader on her return to Pakistan.
Sources claimed that the two sides have already discussed the possibility of the court striking down the ordinance and have evolved a mechanism to deal with the situation accordingly. Musharraf has given the firm assurance to the US and Britain, the two guarantors of the secret understanding reached between him and Benazir, that he will not only facilitate her safe return to Pakistan but also look after her interests within and outside Pakistan, the sources revealed.
The Benazir-Musharraf deal is an international agreement and not just an adjustment between the two parties. The chances of the apex court striking down the NRO have already been discussed by the two sides and this aspect has been taken care of, sources in the PPP told The News.
The PPP leaders are very upbeat about the NRO and are anxiously waiting for the public announcement of the “deal”. Rehman Malik, a senior PPP leader, when approached by The News in the UAE by phone, said it is unlikely that the court cases will be pursued in case the court strikes down the NRO. He said the NRO was not the outcome of the deal between the BB and Musharraf camps, rather it is an ordinance promulgated for creating national reconciliation.
Responding to a question regarding Tuesday’s talks with the presidential aide in the UAE, he said the talks over the next three to four days would focus on Benazir Bhutto’s security and no other issue would be discussed. Asked when details of the deal would be made public, he said the deal would be revealed after Benazir’s return to Pakistan. He added that they were waiting for the Supreme Court’s verdict on Musharraf’s re-election.
However, Farhatullah Babar, PPP’s spokesman, told The News on Tuesday that he had no knowledge of the details and that there was no need of any such announcement after the promulgation of the NRO.

ifti's been given too much importance here, all he can do is 'nanhey muney' attacks at musharraf for revenge, but he lacks the stature to do something big... We should move on and forget the CJ and his heroics

Establishment would never like to make her so strong that she starts challenging them....She will play puppet in their hands and sing their song. The day she tries something ambitious all the evidences they have gathered over the years will be used to defame her again and the whole game will start all over again....

i have a feeling the govt did this so that eventually they knew its going to be struck down by the SC... this way they get a little bit of credibility back and their potential opponent benazir remains in the rags and SC feels like sunny corleone...
