A woman is suing her coworker for helping her after a car crash.

I feel sorry for the woman b/c her life is forever changed (being paralyzed). maybe she feels that if professional help had come first she wouldn’t be like this, or it’d be better if she were dead, even. I’m just concerned how this would affect many other people who are willing to help but now won’t b/c of fear of a lawsuit.

That should be a lesson to those who do not exercise due care. The emphasis here is on due care.
If you notice that this lady pulled the injured lady as a rag doll. If you do not know how to deal with something do not try to. Wait for someone who knows how to do it.

God forbid if I am in an accident I do not want random people to multiply my injuries and my pain.

I cant believe this...who knows what could have happened if she had left the woman in the car??? She helped someone and this is what she gets!

Good Smaritan law is only for emergency workers and that too in case of an emergency! In this day and age, even EMTs think twice before stopping their car at the accident scene if they are not ON duty just becuase of the liability/coverage issues! I feel bad for the woman who helped her out but I think she should have called 911 instead!

Her intentions are not being questioned. She did it with good intentions but she ended up in hurting this lady. So someone has to pay for her pain and suffering , it is American system.

I got my first driver’s license in CA and this is what I read in the handbook which is used for written test purposes:

**Help anyone who is not already walking and talking. Do not move an injured person unless he or she is in a burning vehicle or in other danger. Moving someone incorrectly often makes an injury worse. **

And it is still part of that book.

“The moral here is if you are rescuing or helping someone in an emergency, be sure and administer some medical care. Carry Band-Aids!” said Jim Porter, a California lawyer.

Another moral is that everybody is not trained to help the accident victims , they can end up hurting the person more and that is what happened in this case.

Just Horrendous! but if it were to happen anywhere, it would be in California with it’s notorious highest litigation rate in the US… we’re talking about the state where robbers sue their victims cuz they tripped over their coffee table while stealing from them. Lesson to be learnt… never save a burning Californian.

I mean… how did this lady even have the nerve to sue someone who was trying to save her… shameful really! Perhaps the next person who is not helped by a good samaritan due to fear of lawsuits should then sue this lady for creating an atmosphere where no one was willing to help them.
