Nikkah question

Does anyone have any information on the marriage laws in the US. Is it allowed to perform a Nikkah in a different state after obtaining the marriage license and registering the marriage with a judge in another state. By law you must have a license to marry before nikkah the molvi must then submit or register your marriage in the same state from where u obtain your license and you get your marriage certificate in the mail. In the case you get a license and have already been married legally meaning registered your marriage is it allowed to provide that certificate in a different state to perform nikkah or do you need the license/marriage certificate from the same state where the nikkah will be performed?

While the questions are relevant, why do you want to perform a nikkah in a different state from where the marriage is registered? Wouldn't it just be easier and cause less drama to have it in the same state?

OP: if you have a valid registered marriage in any county, your nikkah should not be an issue. I believe it is easier to perform nikkah without any further documentation.

In order to perform a legally recognized marriage, the officiant needs to be registered as such in that state. If the molvi is not recognized as an officiant in that state, the nikkah will be religiously valid, but the marriage will not be recognized in that state, since the molvi's authority to perform weddings isn't recognized - you might have to go back and have a civil marriage performed.

If you're already married legally, meaning you've had a civil ceremony, then I think that's all the state cares about. You can do nikkah whenever you want. That is irrelevant to the state.

Nikah is not required if civil marriage has already taken place. Civil marriage is recognized both by religion and state. Nikah is just a ceremony after that, and can be taken place elsewhere.

I am not married yet. Yes it is easier to have the registration and the nikkah in the same state but i asked because ofcourse it is causing a conflict. We will be having a reception in my state along with the nikkah but the SO or lets say his family wants the registration there. I thought it shouldnt be a problem just wanted to confirm. Thanks =)

Where you have your nikah doesn't really matter to the US law. Actually they don't give value to Nikahnama. You should have a proper marriage lic, a marriage conducted in the court here in the US.

People have Nikah in Pakistan when both the partners are living here in the US. They just have to register their marriage here.

you can send your affidavit/permission, judge can easily perform civil wedding without your presence.

Is that so? what about to obtain the license i thought both parties applying for the license have to be present.

it is not required to be present physically. you can check local county website.

If you're having a civil ceremony...you're married legally. Its done according to US law. You can have your Nikah anywhere...it doesn't matter. You can present your certificate and that would be sufficient to do a Nikah.

In Illinois...when obtaining a marriage license both parties need to be present physically with IDs.
