Such bills are meaningful tools, which aim to bring about a very long lasting and definitive change in the way the government works. Checks and balances will be provided by the public itself, hence making it a true govt of the people. As far as 'logon ka bibilana' is concerned, you can stop it for a few days by taking cosmetic steps like paying off circular debt with $5 billion loans, and improving electricity for a few days, or announcing metrobus projects in several cities, even though local body elections are just round the corner, but these steps are just that....eyewash. Their utility and novelty washes off once ground realities come forth. We have been living with stopgap measures like these for the past 66 years. Time to make some realistic decisions, something future generations can benefit from, rather than have them waste time clean up the mess their ancestors created.

this is a good step no doubt, it was much needed infrastructure for transparency. how does it get implemented is yet to be seen but at least the law is there now.
so can someone link the draft/ or approved document here? and mention since when it will be in effect and from what date in the past it will be applicable?

just finished reading the document. too much of legal language for a layman like me to understand properly, but what i could extract from it.
good points
- whistleblower protection - awesome thing
- anyone will be able to submit a request for information, and it will only cost 50 rupees
- First 20 pages of the information provided to the requester will be free (other than 50 rupee administrative fee). requester will be charged for any more amount incurred on production of information.
- asks for security of people working on RTI requests processing
- ensures security related arrangements are made withing two days of when request is made
- provides time-line of response, 10 days, which can be extended for further 10 days maximum, it will not be a in-process-forever kind of thing
- it covers lower judiciary as well
- takes into consideration security forces and other national security related interests, and protects them against information release which may harm them
confusing items which i think can nullify RTI to some extent
- there are lots of reasons to reject a request, sooo many, a large number of requests can fall under these categories and can get rejected
- from now on, all third parties (govt contractors, consultants etc) can include a one line statement in their contracts with govt (on behest of govt/ public employees themselves) that no part of this contract or any work carried out based on this contract will be subject to RTI and they will be protected! RTI phir unka kuch nahi bigar sakay ga
- designated officer for each govt department/ ministry will be appointed within 120 days after commencement of this ordinance
- departments can reject requests if proper record is not maintained/ indexed, record maintenance/indexing for RTI will start after Information Commission prepares rules and regulations for this maintenance, and Information Commission will be formed within 120 days of commencement of this ordinance.
- two of the 3 member Information Commission, will be part of "sharamnak judiciary", appointed by CJ PHC. seriously? how come PTI followers will swallow that? look at this board only
- no limit of how old record will fall under this RTI, 10 years, 20 years, 200 years? and after how many years the "security" related record will be disclosed?
- this law has not passed yet, and no commencement date is proposed. which can be anything from tomorrow to next year or even after that. once this bill is passed/ enforced, its implementation, that is, all those 120 years, making rules regarding record keeping and indexing etc means it can actually take year or more to be actually effective
- last but not the least, there are people who will overload KP govt with the requests, and bog it down, not let it do real work but keep them busy in information dispensing.
i believe to address the last two points, infrastructure should have been put in place before implementing the law. a computerization of all sorts of govt records, from last few decades is a prerequisite for RTI to work. and even before computerization KP govt should ensure security of existing non-computerized records, immediately enforce strict laws to protect the information, take steps to avoid any "accidental fire" which will burn all record of some department, remember LDA and KPT fires in Lahore and Karachi?
edit: and the document is just released (without enforcing it) just couple of days before bye-election, aur kuch ho na ho at least it gives some point to IK to talk about in election jalsaas and get some more votes
correction: i see some images of "Naee-bat" and "Mashriq" newspapers saying it has already been enforced!?!? if true, then timeline of those 120 days to form information commission and appoint designated officers start today.

to be realisitic, they PTI government has not shown anything that could be called true leadership. the Chief Minister is non-existent in places where he is needed most. and we have yet to see any concrete thing going. they have already stopped the already going development projects, saying that they will hire experts for it. exactly what kind of experts would one need for building a room in a school and how much improvement can he bring? that is a question to ponder.

**ISLAMABAD: Although promulgation of Right to Information (RTI) Ordinance in Khyber-Pakhtunkhwa (KP) has largely gone unnoticed in the media, it is set to become a catalyst for change by practically recognising the people’s right to know through a law considered one of the best in the world.
While majority of the media persons are unaware of the efficacy of an RTI law that breaks the culture of secrecy and ends monopoly of ‘privileged’ journalists, it is equally useful for the public, allowing them to seek out information about anything and of any department run by public money. “The KP RTI Ordinance contains all the features that are vital for a strong RTI law. This is why it scores 143 and is positioned at the top of global RTI rankings,” commented a World Bank expert.
Before discussing the salient features of the RTI Ordinance promulgated in the KP, it is important to understand Pakistan’s position on global level regarding introduction of the laws promoting transparency and curbing corruption. This law existed in only 13 countries just a couple of decades ago, according to a World Bank briefing note. Now is introduced in 90 countries though it differs in effectiveness, depending on the structure and scope of legal framework.
Pakistan was the first country in South Asia to introduce RTI legislation through Freedom of Information (FOI) Ordinance in 2002 however the law defeated its own purpose given the shortcomings as it was limited in scope with a lot of information declared exempted from disclosure and the subsequent weak enforcement mechanism.
In contrast, India introduced similar legislation in 2005 that resulted in changing the governance paradigm and unprecedented growth of RTI activists other than the media holding the government to account.
Bangladesh and Nepal followed. Now India stands 2nd in global rating of RTI laws, Bangladesh ranks 15th, Nepal occupies 20th position while Pakistan ranks 76th among 90 countries having RTI laws.
Article 19-A of the 18th amendment was a step forward as people’s right to know was constitutionally acknowledged as one of the fundamental rights. Earlier, access to information was mere a statutory right granted through FOI Ordinance 2002. At present, FOI Ordinance is applicable at the federal level. Sindh and Balochistan have also replicated it but nowhere is it serving the desired purpose due to inherent flaws.
While KPK has promulgated an effective RTI legislation through an Ordinance, Punjab has prepared and advertised a draft seeking public comment before presenting it in the provincial assembly. The federal government is working on devising a new RTI law.
Compared to FOI Ordinance 2002, KP’s RTI Ordinance 2013 is a giant step ahead. The former Ordinance has a limited scope, charges Rs50 for each FOI request, requires a reason for wanting information and a signed affidavit that it will not be used for any other purpose, allows 21 days to respond to FOI requests and has no provision for urgent requests. It has vague, open and extensive exemptions; no provision for a harm test; no protection for whistleblowers; designates the Ombudsman - with only recommendatory powers - to hear complaints; and weaker sanctions for wrongdoers, according a brief of World Bank’s consultant.
As for the RTI Ordinance promulgated in the KP, it is a potent law, though there is always room for improvement. Following are its salient features: Extremely wide in scope: It applies to all government departments, the KP legislature, chief minister/governor secretariat, lower courts, and even to private bodies funded by government and private bodies providing public services.
Speedy and free provision of information: An applicant does not have to deposit any fee for submitting an information request. One can submit a hand-written application or send email queries to the head of concerned department (later to the Information Officer once designated). Information officers must help citizens in making requests without inquiring about the reason for requesting information. The concerned department is bound to provide information within ten working days.
For matters of life and liberty, information must be provided within two working days.Punishment for officers denying/destroying requested information: Those deliberately refusing to disclose information, or destroying information subject to an RTI request, can be punished with a fine of up to Rs50,000; a prison sentence of up to two years, or both.
Extensive proactive disclosure of information: This is the information that public bodies must publish. It includes details of the functions and services a public body provides; its organisational set-up; its staffing structure and the salaries, perks and privileges of senior officials.
Clear and narrowly defined exemptions: Legitimate exemptions to RTI are specified in the law, e.g. information that would harm national security, the economy, legally privileged information.However, the KPK law also provides a harm test, whereby if the benefit in disclosure outweighs the harm, then even exempt information must be disclosed. There is no blanketed exemption for defence and other issues of national security.
Protection of whistleblowers: No action can be taken against the whistleblower who brings to light the internal wrongdoings in good faith and in the larger public interests.Independent Information Commission: Contrary to past practice of making Ombudsman an appellant authority, an independent commission will be set up to both hear complaints and enforce compliance with the law, and also to monitor and support implementation. While the chief commissioner, a retired senior government servant, will be appointed by the government along with three members -a retired high court judge, a senior advocate and a civil society representative will be appointed by the Chief Justice of Peshawar High Court, the Bar Council and the Human Rights Commission respectively.

I wonder why Good project managers like Asad and other fellas arent guiding PTI for *QUICK WINS

A Good project manager always identify modules / tasks requiring less customization and configurization and try to implement them quick while running long lasting and definitive changes in the back ground .
Thats how complex projects are implemented successfully . Or else you end up fire fighting throughout the project cycle ( consider PTI tenure here).
Something quick always make your customers ( voters in this case) happy and then it depends on your honesty and professional commitment whether you fool them with these quick wins or go and implements the committed items as well .
Atleast Honesty should be a difference between PTI and other political parties or else I will consider ( and i nearly do ) my first ever vote for Pakistan has gone wasted .

My perspective is that PTI managers (including Asad Umar) are trying to change the lollypop mindset of the public by initiating programs that put more and more power and control in the hands of the public, instead of concentrating it in the hands of a select few at the top. If Pakistan progresses, it will be due to a collective effort of the people at large...not because of 2 flyovers here, and 2 metros there built by 'ABC Sharif'.
Critics did not have an issue with giving Zardari and Sharifs 5 years before they judged them, but dont even want to give PTI 90 days? PTI promised getting rid of major corruption in 90 days, and the implementation of this law is a major step towards that. Local bodies elections will empower local governments, and allow them to decide where they want their overheads or underpasses built, instead of having a provincial make those calls.
Isnt honesty the thing that effectively separates PTI from the rest of the lot as of now? I realize PTI has a few messy situations, but they do deal with them, dont they? If CM is called on use of helicopter, he is forced to pay. If someone is caught with a fake certificate, his membership is suspended. Accountability is the name of the game...not eyewash. Lets give it due time before we start criticizing. I believe the next big thing will be the local bodies elections, and how they will separate KPK from the other provinces.

Yep, IK pic should not be there. I read on twitter that Imran was not pleased seeing it during the launch ceremony and directed CM to ensure subsequent launches do not include his picture like this on KP govt projects.

I didn't expect much from Taliban Khan regarding talibaniyat, though a lot of what can be accomplished in KP would need a "solution" to the taliban criminals, but the rest of the stuff is disappointing . He is still showing himself as an akhrot but his cousins are not running the country like they were in PCB to lend him a hand.
