Brother, Pakistan legal system is ... ‘paisa phaik tamashaa dekh’ … yea phir ‘zoar lagaa our nateeja paa’. Unfortunately Musharraf is not trying to use force that he commands and in such situation anything is possible.
As for Nawaz getting punished on same case, it would not be same case if different person sue Nawaz. All victims of a crime have independent right to sue a person because even though crime is one, people effected were numerous (all on the plane were victims).
It is like, if a person blows a building killing (or injuring) many people inside the building, crime is one and that is blowing the building, still each and every person that suffered can individually sue the criminal that blown the building.
Nawaz Sharif only got a pardon for the case he was convicted on i.e. the hijacking case. The pardon did not mention any cases that were pending and naturally investigations on them can be restarted, as they have been. Ironically the expected SC judgement has put him in a more vexing position, as he can be arrested anytime he comes to Pakistan. This Supreme Court judgement only deals with him being allowed into Pakistan, not the cases against him which he will have to face - just like every other Pakistani. That is inalienable as well. :)

If I was NS lawyer I would carefully study the presidential pardon, and if there and conditions in it. President has the power to issue blanked pardon which is what happened in NS case, and it cannot be challenge in any court of law. As for suing NS thats is a civil matter and not criminal one.

Brother let see .... we have SC (super choor) who is under the leadership of CJ (choor Jagga). Aab dakhna hay kay kiya hota hay :) Time would tell. I hope that people in power really get loose.
Just imagine that what would have happened if people in power were Ayub Khan, Yahya Khan, Bhutto, Zia-ul-Haq, BB or even NS ... as for what Pakistan is, be assured that the person that can kick sitting prime minister (that is on theory not legal), if that person wants to that person can do anything.

When you're suing someone its for monetary gains (money). For criminal matters you get prosecuted, and normally by the state. Trust me on this one. I been in law school for 4 years now.

state can persecute .... but i think that one can sue someone for compensation ... that compensation do not necessary has to be money or is it? In Islam one can sue someone or forgive someone on criminal charges too. For instance, first step to sue someone is to report to police and then press the charges.
Suppose someone break a person leg or whatever, than obviously the person hurt can sue (press charges) on other person and can ask the law enforement agency to take him to court to get punish the culprit by putting him into prison (that is what I know).
What I think, if there is no law is broken or no report is made to polcie and police did not pressed any charges than case would go to civil court but if law is broken and/or case is reported to the police or that charges are pressed by the polcie, than case would go to criminal court. (Police can get involved in both criminal and civil cases).
Nawaz Sharif to face cases on returning home: Former Chief Justice of Pakistan,Saeed-uz-Zaman Siddiqui

Former chief justice of Pakistan, Justice retired Saeed-uz-Zaman Siddiqui said regarding cases against Nawaz Sharif on his returning home that the Supreme Court’s decision is related to his returning home and if there is any case in pending or any new case is registered against him then he has to face it. Talking with Geo News, he said that former president Muhammad Rafiq Tarar had waived all his punishments under Article-45 of the constitution and all these punishments were forgiven unconditionally. Therefore, he cannot be arrested in these cases on his returning home.

Nawaz Sharif, former prime minister and chief of the Pakistan Muslim League-Nawaz (PML-N), and his family plan to return to Pakistan by the end of November after spending Ramazan in Saudi Arabia, sources told Daily Times on Thursday.
The sources said that Nawaz held a meeting with his family members before the Supreme Court gave a ruling on his petition and it was decided that the Sharif family would first go to Saudi Arabia to perform Umrah and spend the last two weeks of Ramazan in Mecca. They would also call on the Saudi royal family to thank them for their hospitality.
However, the final decision on the Sharif family’s return to Pakistan would be taken in the PML-N central executive committee (CEC) meeting likely to be held in London in the first week of September. The sources said that Nawaz’s eldest son Hussain Nawaz, daughter Maryam Nawaz and son-in-law Capt (r) Muhammad Safdar would leave for Jeddah from London on August 30 to make arrangements for the family’s stay in Saroor Palace.
PML-N Foreign Affairs Committee Chairman Muhammad Mehdi said the party workers wanted the Sharif brothers to return to Pakistan at the earliest, but the party would not take a hasty decision. He said that PML-N Chairman Raja Zafarul Haq would hold a meeting of the party’s CEC and the central working committee in the next few days to draw a strategy for the Sharifs’ return to the country. Mehdi said the CEC and CWC meetings would also discuss the provincial-level arrangements for giving Nawaz and Shahbaz Sharif a warm welcome at the Lahore Airport.

Saad Hariri, a son of former Lebanese prime minister Rafique Hariri, has held a meeting with Sharif brothers and advised them to abide by the deal with the government and should not return back to Pakistan.
President General Pervez Musharraf has been assured by Saudi King Abdullah and Saad Hariri, the son of late Prime Minister of Lebanon Rafiq Hariri, that former Prime Minister Nawaz Sharif will not return to the country in the near future, highly placed official sources said. “They (the Saudi King and Mr Hariri) have assured the President that they will use their influence to stop his (Mr Sharif’s) comeback,” said a source. “At least Nawaz Sharif will not be coming back before the upcoming elections (due by early next year),” the official source told this newspaper. The source said the son of former Prime Minister Lebanon Saad Hariri has met Nawaz Sharif in London and demanded him of the implementation on agreement. “He clearly said that if he (Nawaz Sharif) wants to change the agreement, he will have to first finalise the modalities with the government. He also conveyed to him the message of (Saudi) King Abdullah,” the source said. Mr Sharif was on Thursday allowed by the Supreme Court to cut short his so-called deal with the government and return home from exile three years before the agreed 10 years. Meanwhile, federal minister for parliamentary affairs Sher Afgan has said the Cabinet has sent an advice to President Musharraf for restoring sentences of Nawaz Sharif and his brother Shahbaz Sharif after they backed out of an exile agreement with the government. The minister said that if the Sharifs violated the exile deal the government could restore their remitted sentences. The federal minister said that if the Cabinet sent an advice under Article 48 (1) of the Constitution, the President was bound to act on it. Mr Sharif’s Pakistan Muslim League(N) on the other hand says that the former Premier will return home before September 10. PML-N chairman Raja Zafarul Haq told reporters in Makhdoom Rashid that “We express our gratitude to Saudi government for their help to Nawaz Sharif in difficult time.
