Sa1eem, our legal system is based on British common laws, and not Islamic laws. NS was convicted, yes, but he was also pardon by elected president of Pakistan, Rafieeq Tarrar. He was given blanket pardon by president & allowed to go abroad. That can not be undone by Mushrraf, since Mushrraf was not the president at that time, but a chief executive of the country. Therefore, govt cannot try him on same case again.

Paper is an undertaking, not agreement: SC remarks in Sharifs’ case

ISLAMABAD: Supreme Court larger bench headed by Chief Justice Iftikhar Muhammad Chaudhry, while hearing the two identical petitions of Mian Nawaz Sharif and his brother, Shahbaz Sharif, Thursday remarked that the document submitted by the federation in the court is not an agreement, it can be called an undertaking.
The learned bench during the hearing of petitions of Sharifs remarked that only one party has signed the document, so it is an undertaking.
Fakhruddin G. Ibrahim, the counsel of Sharifs, while giving his arguments before the court said that coming back to home is a fundamental right of every citizen under the constitution. The constitution guarantees freedom to every citizen, if Sharif brothers disallowed to return back, the elections in their absence may be called free but not fair, Ibrahim said in his arguments.
The counsel of Sharif brothers, concluding his preliminary arguments said the document submitted by the federation in the court has no legal position and the learned bench should ignore it.
Ahmed Raza Kasuri, the counsel for the Federation, opening his arguments objected over maintainability of the petitions of Sharif brothers.
He sought adjournment for three weeks to get the original documents regarding the undertaking made by the Sharif brothers.
One of the documents presented by the govt (signed by Shahbaz) does say undertaking, so it does not matter what you call it. It is accepted that the Sharif brothers pledged to stay out of the country for 10 years, not take part in politics, in return for their cases to be remissed etc. That is what the brothers denied all along. Whatever the final SC judgement the Sharif brothers have been humiliated - they have lost all credibibilty now.
