ISLAMABAD: The National Accountability Bureau (NAB) on Wednesday issued summons to three retired generals of the Pakistan army for their alleged involvement in the fraudulent land deal which inflicted losses of billions of rupees on Pakistan Railways, DawnNews reported.

The summons were issued to Lieutenant General (Retd) Javed Ashraf Qazi, Lieutenant General (Retd) Saeeduz Zafar and Major General (Retd) Hassan Butt, sources said.

The generals, who were accused of illegally sanctioning railway property to the ‘Royal palm golf club’ on discounted rate, were asked to appear before the bureau on Thursday.

The controversy

A federal audit carried out in 2007 found that the government had lost Rs10 billion by leasing out 103 acres of land to the club built in early 2000 on Pakistan Railways’ land in the heart of Lahore.

A special National Assembly committee headed by Mr Gondal was set up in 2008 to investigate the matter. In a report submitted to the house in October 2010, the committee said the government had lost four times the amount earlier estimated — i.e. Rs40 billion.

The committee had recommended that the contract be cancelled and disciplinary action taken against the then federal minister for railways Lt-Gen (retd) Javed Ashraf Qazi, secretary Lt-Gen (retd) Saeeduz Zafar and general manager Maj-Gen (retd) Hamid Hassan Butt.

**The National Assembly had unanimously approved the recommendations.

The Supreme Court later took a suo motu notice of the deal and completed its hearing on the case in March last year. But it has yet to issue a judgment.

In May 2012, Yasmin Rehman of the Pakistan People’s Party had suggested that the attorney general should convey the committee’s concern to the Supreme Court and facilitate an early release of the judgment. “This (club) was one of the former military regime’s major scandals. We need to reach some logical conclusion on the issue,” she had said.

AWESOME, we want more of these corrupt generals to rot in jail for them to understand they are not above the law.

At the same time, we need our politicians to give them company there as well because they are equally responsible.

Unfortunately politicians are not involved in this huge corruption case. An unauthorized five star hotel was built in 2001 on this very disputed land during Mush’s peak rule, who took over from elected government in 1999 with the promise to eradicate corruption. This is how he fulfilled his promise.

It is not understood why CJ has to poke in every civilian matter where corruption of former military officials are involved? Now he is also responsible for complicating this case since sitting his fat behind on the judgement since March 2011. Because of his stupidity, the case has become complicated, may not be finalized and people may be Scott free in this huge corruption case. This is how the country has been destroyed since 1947, they commit the crime against institutions of the country, but never caught and punished because of combined involvement of top judiciary and top military officials.

Railways land allotment case: three retired generals record statements | DAWN.COM

ISLAMABAD: The three retired generals involved in the railway land allotment case presented themselves to the National Accountability Bureau (NAB) here on Thursday to record their statements, DawnNews reported.

Earlier, the NAB had issued summons on Wednesday to Lt-Gen (retd) Javed Ashraf Qazi, Lt-Gen (retd) Saeeduz Zafar and Maj-Gen (retd) Hassan Butt to record their statements in a case related to alleged fraudulent allotment of 141 kanals of Pakistan Railways land to a golf club in Lahore, reportedly causing a loss of over Rs10 billion to the national exchequer.

The three former generals had allegedly allotted railways property to the management of the Royal Palm Golf Course.

NAB spokesman Zafar Iqbal had earlier told Dawn that a new agreement had been signed in September this year between Pakistan Railways and the club’s management on the directives of NAB under which an additional amount of Rs16 billion was being paid to the PR.

However, the NA’s Public Accounts Committee had called for the agreement’s cancellation, calling for a fresh bidding for the land and disciplinary action against former Railways bosses who had endorsed the agreement.

**A report issued by the NA’s Special Committee on Railways on the allotment of land for setting up Royal Palm Golf and Country Club in Lahore reveals a number of financial and administrative irregularities and recommends prosecution of all members of PR’s executive committee.

On the committee’s directives, the Federal Investigation Agency started the investigation, but later the case was referred to NAB. NAB also sought all the records of the Pakistan Railways from the FIA when it took over the case.

The special committee’s report said the land had been allotted at a nominal price, causing a huge loss to the exchequer because the land utilisation charge was reduced from Rs52.43 per square yard to only Rs4.

The report said construction of a hotel was not mentioned in the terms of reference (TOR) completed on April 20, 2001.

“There was no mention of construction of a hotel in TOR evaluation form filled between April 17 and April 20, 2001, and on the basis of this evaluation the land was awarded to the lessee as the executive committee’s approval was given on the same date,” the report said.

**On a suo motu notice, the Supreme Court completed hearing on the case in March last year, but it has yet to issue a judgment.

This case was well before elections. CJ is involved in this case by not deciding since March 2011.

He is already silent on the corruption of politicians (ISI case paying moneys to anti-PPP politicians to form IJI, thousands of criminal and corruption NRO cases). He is very much active only against PPP and its leaders.

PML-N demands arrest of Gen Qazi | DAWN.COM

ISLAMABAD, Nov 2: The Pakistan Muslim League-N has called for the arrest of former railways minister Lt-Gen (retd) Javed Ashraf Qazi and others allegedly involved in leasing out the railways’ land to a private golf club.

Addressing a press conference on Friday, PML-N’s spokesman Mohammad Siddiqul Farooq said those responsible for causing a huge loss to the national exchequer should be punished in accordance with law, adding that an agreement between the National Accountability Bureau and Hasnain Construction Company for the additional payment of Rs16 billion was not sufficient.

Mr Farooq said he had raised the issue in 2002 and written letters to the then NAB chairman about the corruption committed by Gen Qazi, a former ISI chief.

The PML-N leader said he had also sent private references against PML-Q leaders Chaudhry Shujaat Hussain, Chaudhry Pervaiz Elahi and Chaudhry Wajahat Hussain for their alleged involvement in the wheat scandal, but no action was taken against them.

He urged the Supreme Court to order implementation of the recommendations made unanimously by the Public Accounts Committee in this regard.

He requested the chief justice to take suo motu notice of the 2005-2006 stock market scandal in which then finance minister Shaukat Aziz had plundered $13 billion of 35,000 small investors.

He said he would file an application in the apex court to become a party in the railways scam and other corruption cases.

He alleged that when he raised voice against the corruption of Gen (retd) Qazi he had been kidnapped from outside his house and subjected to torture at the behest of the former railways minister.

وزارت ریلوے میں کرپشن کے حوالے سے نیب نے مزید دو نام وزارت داخلہ کو پیش کیے ہیں جن میں پاکستان ریلوے کے مارکیٹنگ ڈائریکٹر خالد نقی اور حسنین کنسٹریکشن کمپنی کے ڈائریکٹر رمضان شیخ پر خلاف ضابطہ ٹھکیوں کی مد میں 2 ارب روپے کی کرپشن کا الزام ہے۔
نیب کی جانب سے ارسال مراسلہ میں کہا گیا کہ ’ ملزمان نے لاہور میں ریلوے گولف کلب کی 140 ایکٹر اراضی غیرقانونی اور خلاف ضابطہ طور پر تفویض کی جس سے قومی خزانے کو تقریباً 2ارب 16 کروڑ کا نقصان پہنچا‘۔
واضح رہے کہ گزشتہ ہفتہ اسلام آباد ہائی کورٹ نے کہا تھا کہ ریٹائرڈ فوجی افسران آرمی کے احتسابی عمل کے پیچھے نہیں چھپ سکتے ۔ اس سے قبل نیب نے 2012 میں نامزد تمام سابق فوجی افسران کو بیانات قلمبند کرنے کے لیے طلب کیا لیکن ان کے خلاف کوئی کارروائی عمل میں لا ئی جا سکی۔
14 ستمبر 2013 کو قومی اسمبلی کی پبلک اکاؤنٹس کمیٹی نے متنازع معاہدہ کو منسخ کرکے ریلوے کی زمینوں پر نئی بولی لگانے کے ساتھ ہی ریلولے کے 3 ریٹائرڈ جنرلز کے خلاف محکمہ جاتی کارروائی کی تجویز پیش کی، مذکورہ متنازع معاہدے کو تینوں ریٹائرڈ جنرلز کی توثیق حاصل تھی۔
پبلک اکاؤنٹس کمیٹی کی تجویز کے بعد وفاقی تحقیقاتی ادارے (ایف آئی اے) نے اپنی رپورٹ میں انکشاف کیا کہ 141 ایکٹر کی زمین انتہائی کم ریٹ پر فروخت کرکے قومی خزانے کو 4 ارب 82 کروڑ کا نقصان پہنچا یا گیا، ذمہ داران نے ریلوے زمین 4 روپے فی مربع فٹ کے حساب سے فروخت کی جب کہ اس وقت اس کی 52.43 روپے فی مربع فٹ تھی۔
نیب کے ترجمان نے بتایا کہ بتایا کہ سابق ریلوے وزیر ریٹائرڈ لیفٹیننٹ جنرل جاوید اشرف قاضی، سابق ریلوے چیف ریٹائرڈ لیفٹیننٹ جنرل سعید ظفر، سابق جی ایم ریٹائرڈ میجر جنرل حمید حسن بٹ ، سابق ممبر ریلوے ریٹارئرڈ بریگیڈیئر اختر علی بیگ، سابق جنرل مینجر اقبال صمد خان، سابق ممبر خورشید احمد خان، سابق ڈائریکٹر غفار، سابق سپرنٹنڈنٹ محمد رمضان شیخ، ڈائریکٹر حسین کنسٹرکشن کمپنی، پرویز لطیف قریشی، چیف ایگزیکٹو یونیوکون کنسلٹنگ سروسز، ڈاکٹر میکس کارپوریشن، ڈویلپمنٹ ملائیشا اور دیگر پر اختیارات کا ناجائز فائدہ اٹھاتے ہوئے قومی خزانے کو 2 ارب روپے نقصان پہنچانے کا الزام ہے ۔

Will be sad day. Absolute supremacy of law is badly needed. Corrupt generals, corrupt politicians have been taking numbers raping this poor nation. I say reward whistle blowers with all the recovered loot. Reward anyone that can bring to light these ****** generals and politicians who are abusing position of power. Supreme Court should learn from other developed countries and put measures in place to protect and reward whistle blowers.
