Mushy has gone too far. To suspend a man who refused to bow at the altar of military rule and stood for judicial independence is unacceptable. Mushy has no bigger supporter then me on this forum, but this is just wrong.
Opposing a junta is no reason to be under arrest. The facade of judicial independence and democratic institution building has been exposed.
political motivations or altruistic reasons at the base of this whole thing...CJ would have no issues if he did not do any hanky panky.
even al capone was not busted on mob ties, but on tax evasion.
so suspension of CJ may or may not be politically motivated, but hey, if the reasons are true, then he needs to be held answerable to those, no matter the motivations of anyone else.
him summoning ppl in his office and blasting them about reporting on his son's deals and using SC as some platform to push media ..now that was not very cool either.
as I have stated before, just cuz ppl dont like some guy, does not mean the other side is right.

Is there any doubt that chief justice was accused of malpractice before President Musharraf took step of sending his name for enquiry?
Obviously there is no doubt of being accused, as even there is a thread on this forum to prove that chief justice was accused of malpractices much before President Musharraf took step of sending his name to Supreme Judicial council for enquiry.
Now, I could not understand that if Chief Justice is innocent of malpractices, why chief justice is so scared of enquiry? He should have facilitated and helped with enquiry of SJC in all way, clear his name and start working as Chief Justice again, without any accusation on him lingering and without any tainted name.
If chief justice is guilty of those accusations against him, then what he is doing is probably right, taking help of corrupt lawyers and past mega corrupt political parties, as he might be thinking that these corrupts would be able to make so much hue and cry, it might save him from getting sacked.
But I believe that he may be corrupt but not idiot, and knows that if accusation against him is right, nothing can save his skin from getting sacked. So, probably he joining hand with past mega corrupts so that, if and when these corrupts ever come back to power again, they might remember this corrupt chief justice too and might be able to use him to help them in legal corruption.

so with CJ he is also saying that he does not consider the council reliable because some ppl have sharges against them..aray bhai you were their superior, what exactly were u doing in reference to those charges before all this happened. or was it one of those u scratch my balls I scratch yours type of deal?
and what is there to prove here anyways, using his office to pressure journalists to not cover stuff about his son's shenenigans, or the push by the SC against media that criticized stuff...thats not hidden.
lets seperate things here for a minute, is this guy clean or not, seems like he is not. of course he will want to politicize the issue to save his butt. job toh jaye gi, zaleel bhi ho ga.

no sir...lets differentiate between army and civilians rules and regulations...it is not army that is to order is to obeythe CSP's like Qudrat-ul-allah Shahab even dared to strictly opposed General Ayub Khan on various issues ..at first General blowed but then he realized that the guy is right and he very much respected him....and then CJ is far far superior to any CSP and virtually the most respected personality of Pakistan ...and CJ of this repute ...who is world known for his bold and brave decisions aainst Government ...he is not Justice Sajjad hassan Shah or Justice Irshad hassan khan who saw thier seats and interests instead of law and constitution...such a brave and just man...and you treat him like a third lass civil judge...no sir no..this cannot be acceptable at any cost..in any case...... i stil wonder how he dare to call him to his offce in unifm...can you expect Bush to call american CJ in his office fr resign an then do all such dirty things...even Manmohan Singh has courage to do this with CJ of India whatever charges on him....... even if president call him...it is his right to say sorry and call him to meet CJ as this post is so sensitive that he should be completely away from the Executive.... lets take out legitimacy of president, and whether how this was handled was right, becauser that is a circular argument.
If what CJ is accused of is true, should he not be held accountable for it? ...
lets answer that first.
he has been politicizing it because he knows he has dirty laundry.
with someone liek justice javed iqbal stepping in right now, he has no reason to fear that he will be evaluated unfairly, but then i doubt he wants a fair review because facts are stacked up against him, he misused his powers as CJ.
mixing this with all the other talk does not make his misdeeds acceptable

I think CJ would do good adjustment in politics joining corrupt political parties. His mitti is of that type. Probably he did not do anything against those judges with charges, because he might be thinking that someday he might be able to black mail them. Unfortunately, he got caught in corrupt practices with his own pants down and now trying to find an island of corrupt parties where he could land after getting sacked.

he needs to answer a point blank question, if there are charges of corruption against judges and for that reason he does not want them to review his case...what did he do to address those corruption charges prior to today?
and ppl...if CJ can protest having judges with corruptiin charges being able to review his case...why should he be the exception, he can not review cases while there are corruption charges against him. so he was suspended, that is not the same as fired.
when cops get suspended pending inquiry...they are not fired are they..unles snquirt shows that they should be.

So true :). But those who are corrupts themselves (and whose ideals are BB, NS), they could not see the logic. For them, corruption is not such a big deal that a person should get sacked or even charged or enquired on such mundane issues.
Corruption issues are mundane issues to those that have seen corruption since the day they were born. For them, no one should be punished for corruption, nepotism or any malpractices, especially while in government.

Those that eat and spend their own hard earned money, they are careful with every penny they spend and won’t like to waste, as they have constrained resources and they know the value of money. Being Muslim, many may give it to poor but would never waste money.
For these corrupts, they cannot live in that way of constrained resources. They spend lavishly and waste lavishly. That is their life. Stealing poors and spending that on their own lavish life wastefully.
Just imagine that Zardari use to steal resources of poor Pakistan and waste them, even spend that looted resources on giving apple murabbah to his horses. While Nawaz, he also stole poor Pakistan where people die of hunger and this ganja started getting worried of his tind and thus spend millions to improve looks of his tind.

A brave man even respect his worst enemy ...and see he is a CJ of Pakistan still as president has no no no power to non-fuctional him...dismissal is a very far thing...his case is not yet listened ...and guilty is innocent as far charges are not proved and you are treating him like he is a murderer ...looted money..... took bhatta.... drilled the human body....... bank defaulter..etc etc... But I believe BD taking the charge of SJC as head is wrong too, because that would bring him in a position where the result of enquiry will conflict with his own self-interest. This conflict of interest would not be there if the case was not regarding CJ but regarding any other judge and CJ himself was away from office for whatever reason. Actually, BD not in charge of SJC means, it is much better for the enquiry of CJ (for CJ own interest).
The reason is that, if CJ is found guilt, it means that CJ would get sack and then who becomes CJ? It would be BD? Now, the head of SJC being Javed Iqbal as acting CJ, there is no conflict of interest. If CJ is found guilty then still Javed Iqbal will not become CJ, it would be BD. Thus, that conflicting interest related to BD means that morally, BD should not head SJC (even if he was in Pakistan, he should have given that post voluntarily).
As for President expecting resignation, the reason could be that he was thinking that CJ must be guilty of the charges against him. Thus, President must have thought that if CJ is guilty, it is best that he resigns, as if the case would go to enquiry and CJ is found guilty, that would embarrassment the office of CJ (rather all of judiciary) and CJ resignation would have saved that embarrassment.
But obviously if CJ is not guilty, its best that enquiry happens and he get cleared. I believe that President from the information he received, he must be thinking that CJ is not innocent and thus it would have been best that he had resigned. If President would have thought that CJ is innocent, he would not have sent his name for enquiry.
One thing we should remember that enquiry does not mean convicting someone of corruption. It only means, a fact finding exercise. That exercise would not be by President or people in government with President, but that exercise of enquiry would be by judiciary where superior judges would do the enquiry. So, if CJ is innocent, he should not have been so worried.
