ISLAMABAD: The lawyers who thronged the court in support of Mumtaz Qadri, the killer of Salman Taseer, do so in hope of a ‘heavenly reward’ as they believe defending the convict is part of their ‘religious obligations.’

They were there on a chilly Tuesday morning, in all shapes and sizes and ages – thin, plump; old, middle aged and young; dressed in crumpled gowns and with straggly beards or clean shaven, clad in smart winter coats.

There were so many of them that the small room at the Islamabad High Court could not accommodate them all and many had to be content to wait outside in the cold. Those inside were hardly more comfortable as they were pushed and shoved as they stood balancing themselves against the wall, in a room that grew warm and humid while it drizzled outside.

Among those who attended the hearing of an appeal filed by Qadri against his conviction by an anti-terrorism court (ATC) were member Punjab Bar Council Sajjad Akbar Abbasi, former presidents Lahore High Court (LHC) bar association, Rawalpindi, Taufiq Asif, and Ahsanuddin Sheikh, and former president Islamabad bar association Naseer Kayani.

All of them were there to assist the lead counsel for Qadri - former chief justice of LHC Khawaja Mohammad Sharif and retired Justice Mian Nazir Ahmed, who have come out of retirement to defend Qadri.

As a lawyer present there commented: “These two ‘defence’ lawyers are senior to the judges hearing this case.”

But it appeared that most of those present were doing their ‘religious duty’.

When Dawn asked a lawyer why he had associated himself with the case, Mohammad Waqas Malik replied: “Ghazi Ilam Din, who killed a ‘blasphemer’, was represented by Quaid-i-Azam Mohammad Ali Jinnah.”

When another lawyer reminded him that Ghazi Ilam Din was convicted and hanged, Malik shrugged and said: “It was during the government of non-believers and the judge who convicted Ilam Din was also a non-Muslim.”

For them, standing for Mumtaz Qadri is a religious obligation
Similar views were also expressed by the former chief justice of LHC Khawaja Mohammad Sharif after the court’s proceedings.

In the courtroom, it seemed as if there was a dominant narrative.

Mohammad Azhar Chaudhry, former vice-chairman of the Punjab Bar Council, said he returned Rs10 million that the previous PPP government had offered and refused to become a prosecutor in the Taseer murder case in 2011. And he did this, he said, because he is also a Qadri supporter.

Sajjad Abbasi, member Punjab Bar Council, told Dawn that his (Abbasi’s) legal and religious obligations compelled him to support Qadri.”

A senior office-bearer of the IHC bar association in a lighter tone whispered that “the prosecutor in this case will get a US visa for sure especially if he succeeds in getting Qadri’s appeal dismissed.”

“It would become difficult for the prosecutor to live in the country after this case.”

Others went so far as to say that the judge that had earlier found Qadri guilty had already migrated despite the fact that someone insisted that he was still in the country.

Former president of the LHC bar association, Rawalpindi, Ahsanuddin Sheikh, who is representing former chief justice Iftikhar Mohammad Chaudhry in the Rs20 billion defamation suit against Imran Khan, added: “Qadri has the right to engage the lawyer of his choice. I am assisting Khawaja Sharif in this case.”

Advocate Sheikh remained in the courtroom till the end of the proceedings and left only when Khawaja Sharif allowed him to.

Rao Rahim, a young Islamabad-based lawyer, claimed that 33 lawyers were representing Qadri and scores others were supporting him.

He added that at the first hearing on January 27, at least 90 lawyers had attended the proceedings while this time around the number was less.

A security official deployed in the IHC said the number of Qadri’s lawyers was not more than three dozen.

However, as compared to January 27, the strength of Qadri’s supporters outside the IHC building had nearly doubled. They had gathered on the service road adjacent to the IHC much before the proceedings began. Carrying the flags of Pakistan Sunni Tehrik (PST), they stayed there till the end.

Qadri’s brother Malik Mohammad Safeer was also among them. He said his brother had done nothing wrong. “He (Qadri) is satisfied in jail and has asked us not to visit him in the prison.”

Earlier, a young lawyer had said in the courtroom: “He is approaching the court for the legal route. Otherwise, look at what happened in Bannu. People broke into the jail to free the inmates.”

^^^ The man wants to go to heaven why stop him? Let us speed of the process & if any of the lawyers wants to join tell them to jump of a bridge.

Btw, after reading stories like this you wonder if there is any diff between educated people in Pakistan and the TTPs.

TTP is just not a group, it is an ideology and many subscribe to that policy. Education doesn't matter, when it comes to blind faith.

It is all a front ... of course there are people who want Qadri put on trial, convicted and given sentence ... the problem is they would sooner lie about being Qadri's supporters than actually deal out justice - because in this case - justice comes with the price tag of fear of ones own life ...

Many people, even the religious know that Mumtaz Qadri's actions were illegal, but his wildcard is that he acted out of religious motive - now his comfort blanket is the religious mob ... anything happens to him - even legally - then people will single out the judge and lawyers ... the real reason no one wants to touch this case is not some sense of solidarity with Qadri ... it is because they are scared stiff of the mobs.

A part of me thinks they should just let Qadri go ... let his fate be decided another way ... but another part of me says everyone needs to see him in a fair trial to get the full picture on the table.

Nice video graphics, and nicely delivered, but I disagree with a few fundamental concepts that he put in play.

  1. His dichotomy of Free vs Shariah is wrong
  2. He is suggesting that the extremists were against Taseer for his position on treatment of minorities - that is not true … rather it was his position on certain laws that the ignorant people think are part of Islam.
  3. His bodyguard made a personal judgement call - he was an ignorant body guard and probably still thinks he is right. It may stem from his religious leader reassuring him of his action. The support that religious leaders can rally up is purely a political thing. So the best way to diffuse the matter is ensure the religious leaders are held accountable for what they say.

Just thinking about the fact that the guy was Chief Justice of High Court of biggest province of Pakistan sends shivers down my spine.

I dont understand, as per their (twisted) beliefs, Mumtaz Qadri is going to heaven, why put blockades in the way by appealing the death sentence? If anything they should file a petition to expedite the process of execution. Pakistani courts should also STOP This TOPI DRAMA and hear the petition on merit instead of “oh he will go to jannat” or “oh there is a hadeeth that we should do this …do that”.

There should be only 1 question in front of Judges

DID he or DID he not kill Salman Taseer? (irrespective of his beliefs or whatever) and it should not take more than couple of hours to decide.

and if Qadri has so much belief on what he believe in, he should man up and accept the responsibility in court with his free will.

ISLAMABAD: Justice Shaukat Aziz Siddiqui of the Islamabad High Court (IHC) in a division bench hearing Mumtaz Qadri’s appeal against conviction has observed that in the presence of blasphemy law nobody could be allowed to take law into their hands and no excuse is either acceptable for the murder of a blasphemy accused.

The division also posed a question to the defence lawyers that whether a police constable could decide about the beliefs of person and execute him?The division bench comprising Justice Noorul Haq Qureshi and Justice Shaukat Aziz Siddiqui continued with the proceedings here on Wednesday.

Legal counsel for Mumtaz Qadri, former Chief Justice of the Lahore High Court Khawaja Mohammad Sharif, while forwarding arguments in this case said that the people who killed the blasphemous magazine staff in France were there heroes. He paid homage to the assassins of Charlie Hebdo staff.

Advocate Sharif further argued that his client recorded his statement before magistrate under police pressure where he (Qadri) said that he asked Moherar to depute him in the security quad of former Punjab Governor Salman Taseer as he had intentions to murder him.

In cross-examination, Mumtaz Qadri had said that he was deputed for the security of former governor Punjab through a routine matter.

Khawaja Sharif said that while trial of this case no such document was exhibited before the court from where it could be established that the duty roaster was altered. His client Mumtaz Qadri was an honest policeman and had no enmity whatsoever with Salman Taseer or a personal grudge. Khawaja Sharif further argued that a common man because of his religious motivation cannot spare the blasphemer and I am sure Salman Rushdie will be killed if he would ever come here. His client Mumtaz Qadri murdered Taseer after Taseer pronounced the blasphemy law as black law and ridiculed the Islamic injunctions. Being provocative about the statements of Taseer, his client murdered the apostate (“Murtad”) as the penalty for blasphemy to the prophet Muhammad (SAW) is death, Khawaja Sharif advocate further said.

Justice Siddiqui, in the bench, observed that how come a constable could ascertain that who is apostate “Murtad”? Who authorized him in doing so? This country has a law and no individual could take law into his hands.

Legal counsel for Mumtaz Qadri Khawaja Sharif further argued that a son of Salman Taseer, Aatish Taseer, has written in his book that his father used to eat pork and drink liquor. At this IHC bench observed that there is a law for drinking of liquor and someone at the pretext that he eats pork and drink liquor could not be assassinated.

Another legal counsel for Mumtaz Qadri Justice (R) Mian Nazeer Akhtar argued that the ATC convicted his client under the Anti-Terrorism Act (ATA). He claimed that the prosecution did not produce any evidence which could connect the killing of Taseer with an act of terrorism. Mumtaz Qadri has not confessed his crime and he only confessed what he did. At this Justice Siddiqui said that the confession of killing a person if not the confession of a crime then what it is.

Justice Qureshi, in the bench, said that law should not be taken into hands and it has to be obeyed. If we concede to your arguments then everybody will get a licence to kill everybody. Everybody after killing another one will say that he killed him as he was committing blasphemy to the respect and reverence of Prophet Muhammad (SAW). Everybody will use this pretext as an excuse, Justice Qureshi further said. Justice Siddiqui observed that there were factories running in the name of religion in this country. Tomorrow one could be killed as he doesn’t pronounce particular words of Salat-o-Salam or doesn’t wear a green turban.

If Mumtaz Qadri thought someone committing blasphemy, did he ever file an application against him? At which, advocate Sharif said that an application was filed in this regard, but the court had dismissed the application. However, Mumtaz Qadri did not file the said application. Justice Siddiqui in the bench observed Islam has valued the price of human life more than Ka’aba. Justice Qureshi said that Islam has declared the killing of one innocent life equal to the killing of whole humanity. In the case of Rimsha Masih, the blasphemy law was also tried to be used in a twisted manner, he further observed. Last hearing the same IHC bench had observed that this case could not be sent to the military courts.

The IHC bench then put of in this case till February 06 when Advocate General for Islamabad Mian Abdur Rauf will argue in this matter.

Mumtaz Qadri is a former Punjab police security personal who, on a duty for the protection of former Governor Punjab Salman Taseer, had assassinated him on January 04, 2011, at Kohsar Market, Islamabad, due to his opposition to blasphemy law.

Separately in another case, a division bench comprising Justice Athar Minallah and Justice Aamir Farooq issued notices to the state seeking its reply after an accused Umar Abdullah Abbasi allegedly involved in the murder of a former federal minister for minorities Shehbaz Bhatti, has filed an acquittal plea before the court.

That does kind of make you think...how many terrorists did he let go when he was the CJ b/c he agreed with terrorists' ideology. After all, Taliban also argue that Pakistani soldier they killed are almost "mutard", and deserved to be killed.
