Name of Mr. Justice Rana Baghwandas became well known even on street level all over Pakistan after 9 March making Chief Justice of Pakistan Mr. Iftikhar Mohammad Choudhry “non functional”, a legal term not known to the world before. But for the people of Karachi this name was as respectable and known even in eighteens. Hardly any week went by during those yester years of eighties when names of Mr. Justice Rana Baghwandas, Mr. Justice Nasir Zahid Aslam and Mr. Mr. Justice Moamoon Qazi did not appear in the newspaper as they were known for sitting late hours and as public spirited judges. Mr. Justice Baghwandas along with his other colleagues got their names written in gold in history of Pakistan when recently they refused to take oath under one man made constitution. A usual criticism is that these are the same very judges who earlier took oath under a similar one man made constitution. This is quite right but these critics forget that situations do change. For example Jamat-e-Islami. This party is criticized that it was against establishment of Pakistan which is quite right but their then analogy too was equally right and substantial. These people had a very valid logic that the British snatched undivided Indian from Muslim rulers hence it should be returned undivided in same position to Muslim. It was logical. But when Pakistan came in existence today Jamat-e-Islami perhaps is the one which always remains on forefront in safeguarding country’s ideological boundaries. I myself viewed Altaf Hussain asking Indian Government during his visit for long stay resident permits to his party workers as they wished to settle for better life in India. Indian government refused. I have press clippings from Indian press to this effect. There are many other similar examples. Mr. Justice Baghwandas would do a further good for this unfortunate nation if he makes some of the mysteries public. These are that when Mr. Justice Iftikhar Mohammad Choundry was made non functional on 9/3/2007 was he on “leave” at his own or he was sent on leave. Whatever may be the case on that fateful day within an hour world over TV channels were telecasting live the reaction of the nation. Did it not come to his knowledge in his place of leave that day or at least next day. As and when however it came in his knowledge, did he as a wise duty bound employee knowing well he was the next senior most responsible to his Department, approached, contacted, phoned his Department to know the situation or informed his department that cutting short his leave he was promptly coming back to Pakistan. If he did it what was the answer to his coming back call. The law minister Wasi Zafar told on TV that Mr. Justice Baghwandas was not contactable which was unbelievable. Would he clarify if on going leave he really had not left his contact address or phone or he was advised to switch off his phone and remain silent. He would do a good for the national history if feeling his national responsibility he clarifies these confusions. General Musharraf is generally a good man. Last week very startling but unfit questions were made in an audience in President House weekly TV programme but he most admiringly replied each and every question very sensibly with convincing logic. However as usual he failed to give answer about CJ saga. He always failed in answering this particular question. He always says he filed Reference as per constitution but court did not give its verdict on those complaints included in the reference. I am more than convinced that President had never been apprised that later on each hearing one by one due to embarrassing satiation the Government withdrew from those points/affidavits or from attachments with the Reference and there was nothing further substantial left for the court to consider. From the replies which President keeps on giving on this subject it is clear that his advisers had not kept him apprised of this. Last month in a Saudi Airlines flight I read Saudi newspapers. A front page headline was the statement from Mushaid Hussain, a dire Musharraf supporter that he is always convinced on CJ matter that the advisers gave the wrong advice to the President. Mushahid further added that despite his efforts he has failed to find who those advisers were, even once he enquired this from the President who did not give answer. Mr. Justice Baghwandas’s clearing of these points I am sure will make many hidden things crystal clear and may perhaps give way for a rethinking for the President who I personally believe accepts where the wrong is and what correct should be done.

Re: Mr. Justice Rana Baghwandas may please act
I'm sorry, but Mr. Justice Baghwandas is in protective custody of our govt against his will for his own safety from terrorists at his Karachi resident, and is not contactable at the moment. However, we are told that he is allowed 1 hour walk everyday outside of his resident, but visitors and family members are not allowed to see him for safety reason as well. You never know terrorists could come disguised as his family or friends. Stay tuned... will keep you posted.
