Someone I know is mentally unstable and she’s a US citizen. She has been talking to a man in another country and has gone to the country to get married with him. Now, the guy knows 100% that she’s not normal and is also quite older than him but he still wants to marry her. What can be done? Should Immigration Services be notified and will they do anything or will they say they can’t do anything because it can’t be proven if the guy is legitimate or not. But the woman is really not normal, she has been diagnosed with a mental disorder in the US and this can be proven through her medical records. Can anything be done to stop this marriage from taking place or even prevent the guy from getting the green card if they’re married?

What is wrong with a little 'marriage of convenience'? I dont see much of an issue. That lady in her situation may not be able to get married so its not that she is not getting any good out of this.

**i think first of all, an american citizen or any citizen of any other country has the right to get married anyone anywhere. so that shouldn't be an issue when it comes to the Immigration. i'm afraid NOTHING can be done. even the Govt can't do nothing unless the guy has a criminal record and he is a threat to the host country.

She'll not get anything out of this marriage and if the guy ditches her after getting a green card then it will really worsen her medical condition(severe clinical depression and psychosis disorder). She is in her 60s and she is divorced with adult children. This marriage will leave her with worse health issues.

In my opinion, I think the law does not prohibit him for doing so but legal advocacy can be explored, but I wouldn't say it would be too helpful. On ethical grounds he is not doing him or her a service. Sounds like your concern is that he is a fraud provided that if you delete the green card out the picture he will no longer be interested in marrying her. In a legal situation you would have to show proof of that. It would be hard to obtain the proof if the wife-to-be as not in agreement with that.
Ethically the marriage would be a concern. I don't know if there are laws out there prohibiting marriage of this nature because with the nature of the work I do I've come into contact with so many people diagnosed with mental disorders married to other people in and outside of the USA, the law as I know it cannot prevent them from exercising that right. If you are mentally or physically handicap you are still entitled to get married, those rights are not denied to anybody.

That's what I thought, I guess nothing can be done. He is suspected to be related to a drug dealer in the US but we don't know for sure, only heard from someone.

It's very concering considering what people back home do to get green cards....I have even heard that people steal blue passports and alter them to gain entry in US....Sick sick world out there. Makes me wonder where is God??

I know very concerning! They really need to regulate this somehow! Why is it the spouse always joins the other half in the USA and not the other way around, because... if it were the other way around they wouldn't be marrying you!

its the choice. American spouse can go and live with the other partner in that country but very few pick that option.

fact that the lady is a mental patient, plus the fact that she is 60 would raise a red flag for sure when they would go for an interview in front of an immigration officer.

But do immigration people have this information(about her medical condition)? don't they just have info about criminal background and general info?

I know but I'm just stating that this is an obvious red flag. ultimately it is a choice, but I agree with that option and that is usually the married couple separate after marriage and the USA citizen returns to America to petition for foreign spouse to come over.

I am not a marriage lawyer but at least when it comes to business contracts; if it can be proven that one party is mentally incompetent (or of not age) the contract be invalidated. So I would think if you could prove the woman is LEGALLY mentally challeneged or married under duress, i think the marriage could get annulled.

I think they only ask for health records of the person who is being sponsored.

USCIS does NOT check the medical records of the U.S. citizen.
HotTea has the best legal option for her family. You can not prevent them from getting married. BUT......once married, she will apply for immigration papers for him. At that time, people who know the women very well such as her adult children should send NOTARIZED letters to the USCIS. The letters should not be emotional, should include details about her medical history, and WHY the person believes that this marriage is a sham (ie. the man is marrying her only for papers). The letters will send red flags to USCIS and will make it MUCH harder for the man to obtain legal status.
