The constitutional provision is there in most countries. It is used in extreme circumstances where, for example, the courts convict a person (having no other choice under law) but the death sentence might damage a country’s relations with another country and therefore as a circumvention, the president intervenes and pardons the criminal.

No where else in the world, however, the pardoned criminal is kept as a minister. In Japan, the minister would commit suicide, in most western countries he would be fired and sent to jail, in India he would at least resign.
