In a surprising move, 3 Judges of Lahore High Court have issued a stay order against establishment of Islamabad Court, which was just announced by President (i) Musharraf.

The Lahore High Court (LHC) issues stay order against the establishment of Islamabad High Court (IHC), the sources said.
The LHC issued the order on a petition filed against the establishment of Islamabad High Court, the sources added.

Islamabad doesn't have the HC. The question raised by the petitioner is that army chief under pco doesn't have power to amend the constitution (constitutionally there are only 4 HCs) to set up a new HC in Islamabad. Thats the whole issue here. BTW, only parliament can create new HCs and the amened the constitution, but hey...we're talking about Pakistan. Rule of Law or the constitution hardly matters.

SC suspends LHC stay order on ISB court

ISLAMABAD: The Supreme Court today struck down an earlier order of the Lahore High Court to stay the establishment of the Islamabad High Court and forbade it from hearing the matter anymore. Pleading for suspending the Lahore High Court order Attorney General Malik Abdul Qayyum said the provincial court has no jurisdiction to suspend the constitutional amendment made by the President during emergency proclamation. He said the apex court had upheld the emergency measures, including setting up of the Islamabad High Court. The Attorney General said the LHC judgment is based on malafide intent and even he was not notified for appearance during the hearing. The 4-member apex court will now hear the matter on January 7.
