KIDNAPPING LAWFULLY

During the recent hearing of missing persons case on 26 September as worded by the newspapers the Supreme Court remarked that it would not pardon those found responsible for kidnapping persons “unlawfully”.

When the court leaves it on an accused to opt if he leaves the post of parliamentarian gained on bogus degree or opt for further processing of the case rather than decide the case purely on law of land. Or when similarly when on a request from Amna Januja the brave women struggling not merely for her own missing husband but collectively for others too for arranging a meeting for her with the DG ISA, the Court rather than giving instruction to the point or to the contrary, is more interested advising compensation to the families properly, in that atmosphere kidnapping “lawfully” should not be any surprise.

It is very sad story which started with murder of Liaqat Ali Khan.
What the others can do ?
They kill them.
See at Bhutto ,Bugti,Benazir.
But N$ was lucky to escape alive
From Lahore so permitted after an agreement,
Even N$ was not brave enough .

True. It is difficult for our 'establishment' to brand a Punjabi as traitor.

I do believe injustice has been done to many leaders including Bhutto, but I am not sure if killing of Akbar Bugti would consider murder.

For all practical purpose he was leading an armed gang in the mountains, as become legitimate target.

Unfortunately in our cultural as long as one is politician he is above the law.

Who should decide if one is a 'legitimate target'? A general or a court? If a politician is considered to be above the law, does it give military the right to act above law as well?

btw, the general who proclaimed Bugti as a 'legitimate target' designed Kargil operation which resulted in half of our frontier constabulary being wiped out.

Back to the topic: The military should at least tell the family why a certain person is taken in and if that person is still alive.

When someone is carrying arms, and leading an insurgence group and refused to surrender when cornered he is automatically a legitimate target.

Again one should not be killed once arrested, but during battle he has no immunity.

Did Pakistan declare war with Bugtis? Was there any political consensus that they should be attacked? Is there any evidence provided to the nation till now that Bugtis were/are acting against state of Pakistan?

I am not saying that this particular group is peaceful and innocent. Just saying that there has to be a legitimate reason, debated and approved by a legitimate authority for our military to act. We have not learnt anything from fall of Dhaka.

Agree with you but for that we really need to make some change in the laws to provide necessary tools to our security agencies.

Here problem is most the criminal been released by court system (due to no fault of courts, mostly ineffective investigation as well and lack to legal structure to address current days challenges).

That force security agencies to resort to unlawful detention (we can also consider kidnapping by state).

If you looking at major crime breakthrough in specially in Punjab most known criminals out of the street not become of legal system but because of so called "Police Encounters" which are mostly staged and there are high chance that police also take liberty to settle personal scores.

Most of 3rd world counties used there secret cell to purge these elements when problem could not be handle within legal frame work (India has done during Sikh insurgency, as well as Indian police killed many gangsters using select group of police officers called "encounter specialists".

Sri lanka has done same not only during height of Tamil insurgency. they also has done this to settle with run away gangster-ism those peoples picked up by so called secret death squad and never be heard again. But again these are could be abused to settle personal scores (One of my friends partner was take out of this squad, any my friend can vouch for him that he was no gangster or criminal but he might steps on few toes because of his attitude).

Currently our security forces using same, I do have some sympathy with them if it is careful and surgical, but given our culture too much abuse is taking place thus we might come with something more practical yet could nto be abused easily.

To me this offer best solution but we need create a whole new system for that.
