There are three ways by which seperation can take place between muslim couple.

Talaq, Muslim man can invoke Talaq , pay Haq meher (if not already paid) and then women would live with him ( or the residence provided by him) during the stipulated period of iddat. They can re-consider the decision during this period. After the completion of iddat the procedure of Talaq (divorce) is complete. Man and women are free to marry anyone they like. Even they can re-marry eachother, of course with a new haq meher. gifts exchanged, given to wife should not be sought back.

Khula is woman's right to ask for divorce. She has to surrender haq meher. Apart from that there is no other condition. There can be any reason, or no (good) reason at all, for khula

Fasaq nikah- it is seperation by court. There could be several reason and many possible outcomes.

In general thats it. There are some other details too

Khula is when the wife asks for a divorce...........best to consult the experts on how..........a family practice attorney should be able to help.

If the husband goes off without telling the wife and is absent for more than a certain period of time.............4 months in some fiqha.......the wife is entitled to a khula........but I could be wrong on that one...best to check wth Scholars.

from what someone told her. she has to write a letter saying that she wants a khula... is that true?

I guess b/c not everybody has a blessed married life like you. Instead of complaining about them, why not just ignore and count your blessings?

Khula’ is a system provided by Islamic Shariah by which the wife can seek separation from the husband. If the marriage is beyond reasonable repair, and the wife seeks separation, then she is required to pay a fee to the husband. When she does this and the husband accepts, then a Talaq Ba’ina occurs, or an irrevocable divorce. Custody of any children is usually decided by the Qazi (Muslim Judge) and the principle varies from case to case.

Khula is normally taken through a judicail process... A court (Islamic Shariat Court in case of Pakistan) needs to be contacted provided it's outlined in the laws of the country...

parting with kindness is necessary. when a marriage is suffering, so is one of the two people in it, or possibly both, mostly women suffer more.
so parting is a must. when all options and efforts for mending the relationship have been exhausted.

I agree with you Big time.
I think all those who are married should try to make thier marriages work, instead of going for divorce or Khula.
As a matter of fact, the Khula rate last year in Islamabad was 25%. I pray hard if people just become a bit patient and be thankful of what they have!
