I’ve read in several sources, such as the following, http://www.soundvision.com/Info/weddings/faqs.asp and http://www.islamonline.net/fatwa/english/FatwaDisplay.asp?hFatwaID=49523, that whilst the majority of scholars agree that the wali is neccessary, this was not the opinion of Hanafi fiqh, where the wali’s consent is merely recommended.
And in several court cases in Pakistan, judges have validated marriages without walis on this basis that it is permissible under hanafi fiqh.

its not even majority of scholars from my knowledge its only Imam Shafi who makes it explicitly necessary......and only Imam Hanafi who makes it expliclty not necessary....the other two prob do not have any fatwas on it so they are not quoted..
in spite of Imam Hanafi's fatwas, majority of propah Muslims in Pakistan don't really accept it....This legal allowance is not accepted in social mainstream...
but stuff still happens...i need to know all sides of the picture...
