Diyat Law should come under a supervision of a council or a legal authority. Make it a well documented all formal and a legal procedure to put a stop on the invalid and disgusting drawing room deals. The courts should be the one to decide whether diyat could be applied or not.
^^^ That is a reality check. The victim was no ordinary person, yet Shahrukh Jatoi and his gangster family was able to intimidate victim’s family into withdrawing the case. I agree this was not a terrorism case, and I agree victim’s family has right to Diyat. But the way these Jatois, Talpurs, Lasharis and whatnot have twisted the arms of the system is scary. That is why APMSO and later MQM were formed.
Whether it is a dispute with your tenant or neighbor, or the disputes on the national level. Whoever has greater capacity to wage violence, gets desired result in a dispute. The constitution and laws of Pakistan work overtime to achieve the results desired by the person or gang who commands greater capacity to wage violence.
Agreed-Following people still waiting for the justice-Custom Inspector Aijaz Mahmood, deceased Noor Mukadam, deceased Sarah, wife of son of Ayaz Amir. Sharif’s money laundry cases were withdrawn and given cleaned chit. I can list many such undecided cases due to connection with elite or establishment. ‘Tarikh e Insaf’ even could not do anything about such case.
This is a great observation. I think this is true everywhere. In developed countries, the state has the greatest capacity to wage violence.

Deeyat law should be banned in Pakistan as it is being used to protect criminals. Our unruly musaaalmanzzz don’t deserve such laws.
^^^ The debate that whether the Deeyat law should be changed/abolished is the proverbial “Truck ki Batti” that has been very cleverly floated by government, judiciary and media. The aim is to distract the public discourse from discussing how unfair and difficult life becomes in Pakistan when anyone is up against someone who has greater capacity to wage violence.
I put a hypothetical question here. Had Shahzaib murdered you or me in the same circumstances, would there be even an FIR registered against Shahzaib given the fact that his father was a DSP and the family has strong ties in PPP ? It took no less than Nabeel Gabol, who is a close relative of Shahzaib, to get the FIR registered after Shahzaib was murdered. Otherwise, police was not even registering an FIR.
The point I am trying to make is that you can make any law but if a victim and witnesses of a crime are not safe from the violence of the associates of the accused, then that law will fail to deliver justice to the victim. A relative of mine got kidnapped from inside Karachi University few years ago. My relative was able to escape within minutes, in front of Rangers, before the kidnappers were able to drive out of the campus. Rangers arrested the kidnappers right away, did all the formalities. But within few months people from Rangers and political officials asked my relatives to not to pursue the case as government cannot guarantee safety of family otherwise. My relatives were just happy that no one got injured or killed, and stopped pursuing the case. No Deeyat law got involved !
You are absolutely correct. Even without the deeyat law, justice is hard to get against the powerful. But, the deeyat law doesn’t make things better. It makes things worse.
