According to a news appearing in the press Mr. Justice ® Nassar Aslam Zahid has revealed that a fund for the judges who acting on their conscious did not take oath under a one man made constitution and today are practically “un-employed”. No doubt the advocates are courageously keep struggling for these judges but they are alone. I do not see now much hope on restoration of these judges. The advocates themselves too are financially suffering and upto what stage they would suffer. Every advocate is not earning like Sharifuddin Pirzada or Qausri. On the other hand we are in East not in Europe where civil society’s protests count. Justice ® Nassar has announced the Fund has been established and account in Habib Bank in Sindh High CourtBranch has been opened. There are no other details viz name of fund or account number or address. As a citizen of Pakistan I have all respects for the deposed judges and I wish to monthly or once in three months combined for three months deposit my 5% salary but I do not where and to whom send it. I have tried on the internet. On internet search engine I found names like Sindh Bar Council and Punjab Bar Council but there was no detail about it. I may make it clear that I am not sending my charity. I will be sending my community contributions like in Pakistan Ahmadia society’s each member rich or poor contributes for the community cause. During my service in Saudi Arabia I found a very interesting thing. The Indian Kerala community invariably contribute in small groups for the community welfare. If an Karalitie is fired from service or gets his shop say fire damaged, the whole community contributes to re-establish the shop. If one unemployed reaches abroad from Karalea, he is given financial help to hire a shop, furnish it and on credit whole supplies are provided. The same thing I found when I was in Duabi amongst though academically illiterate our Pashtoons doing the same. Judges miseries I know are temporary. Musharraf is not to remain much long now. In the new government there would be many who would sense the change in the wind and recognize the new brains of the society including of common man and would support the demand for restoration of judiciary and judges may perhaps get back to their seats 20% chance) but definitely would get all retiring benefits though a bit later. I know this nation is not dead and would not let judges remain without their retiring benefits. These judges have shown their conscious. My Lordship Mr. Justice Iftikhar Mohammad Choudhary, he may be corrupted as Musharraf today says or may be rude treating badly with advocates, but fact is he created history by standing courageously when he was surrounded by intelligence chief and uniformed big wigs on 9 March. Some quarters like MQM though rightly raise a question that many of those affected judges including Justice Iftikhar Mohammad Choudhary earlier had taken a similar one man made PCO. It is quite right but these circles like MQM cronies forget the situation gets changed. For example when in 1998 Indian plane Ganga was hijacked to Lahore everyone including myself termed it a brave freedom move. Zulfiqar Ali Bhutto himself went on tarmac near the plane and shouted with praises waving the hijackers. Later the nation found we were all wrong. If those judges earlier took a PCO oath with Musharraf, today they did not re-take it because passage of time proved them that their earlier move was wrong and this man is no more trustable. So rather than criticizing them it should be appreciated they preferred not to do the same mistake despite knowing it will put them into financial problem. MMA leaders are mostly educated from Madrasas and from modern schools averagely. Being simple people they trusted Musharraf that he would shed his uniform soon so they joined hand with him. It was not wrong they did a good thing. But later when they found the General has backtracked from his publically make promise on TV these MMA leaders are today opposing him. Those from the 9 March SC preferred to take oath under Musharraf PCO I do not hate them or criticize them. They did this knowing well they have families to feed. They knew well our society is not so developed to “practically’ appreciate if acting on conscious they did not take oath. But those who entered the today’s SC and High Courts out of term I take them all shameless creatures and only opportunist from whom no justice can be expected. There so far taken cases specially Geo restoration case is an evident. How strange is the SC which world over take notice of long confinement of citizens, is totally silent despite knowing their own court (ex) chief is confined and under house arrest without any “official orders”, his children are deprived of education yet these so called new entrants are silent. I read somewhere that once a question was raised by a press reporter to Quaid-e-Azam that he was the strong slogan raiser and supporter of Hindu Muslim unity and collective efforts for freedom and today he was struggle for separate Muslim State. Quaid-e-Azam’s reply though is a short sentence but speaks volumes and is a self explanatory answer to those who criticize judges who refused to take oath for the same man with whom first they took oath trusting but found him untrusable any more. Quaid-e-Azam said “I am once in Primary classes”.
