In Pakistan, Hudood ordinances are based on Islamic principles and are applied to Muslims and non-Muslims alike. Some Hudood ordinance cases are subject to “Hadd”, or Quranic punishment; others are subject to “Tazir”, (a secular punishment). Although both types of cases are tried in ordinary criminal courts, special rules of evidence apply in Hadd cases. For example, a non-Muslim may testify only if the victim is also non-Muslim. Likewise, the testimony of women, Muslim or non-Muslim, is not admissible in cases involving Hadd punishments. Thus, if a Muslim man rapes a Muslim woman in the presence of several women, he cannot be convicted under the Hudood ordinances because women cannot testify. Similarly, if a Muslim man rapes a woman in the presence of non-Muslim men and women, he cannot be convicted because women and non-Muslim men cannot testify. All consensual extramarital sexual relations are considered a violation of the Hudood ordinances; thus, if a woman cannot prove the absence of consent in a rape case, there is a risk that she may be charged with a violation of the Hudood ordinances for fornication or adultery.

Such interpretation of Shariah has had a harmful effect on the rights of women and minorities, as it reinforces popular attitudes and perceptions and contributes to an atmosphere in which discriminatory treatment of women and non-Muslims is more readily accepted.
I would say that take this crummy old 7th century system to where it belongs. It has no place in civilized societies.

but tell u what thing i think ther is no such thing as u described ........first thing is first that if MUSLIM MAN do such thing, i mean rape a woman , no matter whether a law required him a punishment or not but ALLAH will punish him in the end for what he did which he wasnt suppose to do!!!!!!!!

This is no way to run a society.
All it takes, in a community of several million people, is a few men (reformists, let's say), who don't particularly believe in Allah's laws, to be able to then run rampant through a community which bases it's laws on the belief that Allah will get the bad guy at the end of the day.
Try telling a kafr that Allah will fry his arse when he dies. Watch him laugh at you.
You must have laws to protect the structure of society. The rules that NYA posted are a way to subvert that structure.

Shariat is very clear on this subject:
If a man accuses a women of adultary, let him bring forth 3 witnesses, who actually witnessed the act... if he cannot than he is himself to be punished....
this is Hudd...limit set by Allah....
We must understand the difference between Hadd and Tazeer....which most ppl comfuse...
Hadd is what has been prescribed by Allah...if the conditions of Hadd are not met than law makers can impose their own conditions BUT their penalty cannot exceed that beyond what is set by Hadd....
in case of adultary if married ppl are involved in adultary and 3 witnesses are found than they are to be stoned to death....Otherwise the judge may decide to either let them free for lack of evidence or prescribe some minor penalty based on circumstantial evidence....but i am not sure as to what are the limits in this case...and what is preferrable.....
may be some one else may shed more light on it...

islam also moves with the times. If their is Dna evidence a person can be convicted of rape no matter what.

in a muslim country where islamic law is practiced ie libya rape is very very rare. In the usa a rape happens every 3 minutes and this is your civilised country.
islamic law works because rape is so uncommon where the sharaih law is implemented.

In cases of Adultery the sharia calls for 4 witnesses not 3 as PukkaDesi stipulates.
Our Fundo brothers screw the real intent of these verses/sharia by trying to be precise in their emulation of the 7th century in which likeness the quran was delivered.

Romi Yaar, yes, it is a legacy of Zia. Subsequent governments did not even want to touch the Sharia Law issue fearing reprisals and backlash. Even today, ask any Law School Student in Pakistan, there is not a single “subject” on Islamic Jurisprudence taught at the Law Schools, there is something called “Islamic Studies” which only briefly touches upon this area. So it really is very unreasoning to enact laws without providing sound legal training. But the point is far different than just providing infrastructure, it is of providing equality to sexes. And I am sorry to say, that Shariah does not offer such equality (at least as it is interpreted by present day Ulamas). The only way to provide equitable justice in criminal matters to such a diverse population as Pakistan is to enact laws that address equality, and are not made to favor only one segment of the population. You may think differently. Or you may not.
anchal .... karay kay witnesses can be found in any country under any law.... every law in the world is basedon witnesses... it is assumed that witnesses will speak the truth under oath....
anyway in Islam there is harsh punishment for false witness... i think it is 40 durras and than the guy can never be a witness as long as he lives.... tell me one law which has such harsh punishment...?
