is it ok to extend B2 visitor visa ...............

hi ! actually this qs is for my mom who’se currently in U.S on B2 visitor visa , it’s her first ever visit and was permitted to stay for upto 6 months period which is about to be over soon , but i want to keep her ( as i’m studying) beyond her six months alotted time , is it okay ?? i mean i know how we should file for extension but my concern is will it effect her visitor visa ( which is multiple entry in U.S for upto 5 yrs) ?? or could she face any problem @ immigration office on her way out of U.S or at time of her next entry in U.S ?? would this extension be considered as breach of laws or it’s legal ?? does any of u have any idea , or experience in this regard ?

no..there shouldnt be any problem with the extension. You will get a new I-94 in the mail, valid for another six months...and thats what your mom would use to exit after six months...no trouble or legal issues at all.

Lets not jump the gun here. Apply for an extension BEFORE the current visa runs out. INS used to be very slow in responding to this and by the time the response came in, the visitor usually had left US anyway. USCIS (the new name of INS) may be a bit more efficient. In any case, keep a record of the application for extension with you. If USCIS decides on the case then they will either send a new I-94 which you can use to exit out of the US. Or they will deny the request and give your mom a certain number of days within which to leave the US. She should leave the US by that time.

Even when she complies with USCIS decision, the computer system will still show that she over-stayed her initial 6 months, and she may have to explain why she did that to the visa officer next time she applies for a US visa at a US Consulate. These are the kinds of info visa officers use to drill people during the interview.

Do keep a record of applying for extension. A likely scenario is that USCIS will not decide on this in time, and when your mom is exiting US, she should provide a copy of the paperwork of applying for extension to the airline personnel along with her I-94. There is no formal Immigration exit in the US and usually airline folks take care of the I-94. Otherwise, airline folks will get confused with the I-94 of an earlier date. The other option is to go to the USCIS office at each airport and show the application for extension and they will enter it into the system and stamp your mom's passport. This will help take care of the confused airline staff.

I actually know people who got denied of visit visa because they over stayed their visa (even though legally) in the past by applying for extention. You never know. I don't mean to scare you but that is the truth.

thanks guys 4 yr helpful replies , we’ve decieded not to apply for extension , as she has merely few weeks of stay left ( out of given 6 months stay ) so it’s a bit late now , also i’ve visited other forums related to u.s visa and have come to conclusion that if the extension request is denied & the applicant/ visitor have stayed in U.S beyond the permitted time ( period allowed to stay by immigration officer @time of entry in u.s) than the actual visa (given by u.s embassy officials) become void … instead i’m gonna go & visit pakistan this summer:aejaz:

Well, if you have decided not to apply for an extension, then that is fine. It will save her from additional questioning next time she applies for a US visa.

However, just to set the record straight, it is not true that if her extension request is denied then the original visa becomes void. Nothing like that happens. The denial of extension notice comes in with a date by which the applicant must leave the US. As long as your mom leaves US before that date, there is no impact on your visa. I don't know who/why you were given this wrong information.

dont do that. Next time when you will come they will ask N number of questions and most probaby will deny you entry.

If this is her best visit, unless you can demonstrate very strong need, it is better NOT to apply for extension, even if there is a lot of time to do so. For the first trip, like a credit history, it is better that she returns in time, so that when she applies in future, they will know that she will return and not disappear within the US.

In many many cases when people return within time the first time around, when you apply next time, they automatically issue a 10 year visa ... it happened in some cases I know a couple of years ago.
