Is "alive" seafood halal?

Some seafood such as octopus in some cuisines are served raw while they are still alive.

Is it Islamically permissible to eat seafood while it may still be alive?

Octopus was used just as an example, and of course it is halal. If not, we can discuss that later.

That is a good question. Japanese, in the name of freshness, love to serve alive sea animals. I want to know the answer too.

I think, eating an alive animal of any sort is not halal. The reason is that in doing so we are unnecessarily inflicting pain on that animal. It should be noted that

1) We sharpen our knives to inflict minimum pain
2) we don't start dismembering the animal (while doing qurbani) before making sure that it not alive any more.

Dismembering or eating an alive animal is in my opinion a gruesome act.

Allah SWT said in Surah Baqarah verses 173: "He has only forbidden to you dead animals, blood, the flesh of swine, and that which has been dedicated to other than Allah . But whoever is forced [by necessity], neither desiring [it] nor transgressing [its limit], there is no sin upon him. Indeed, Allah is Forgiving and Merciful."

Dead meat: **Maitat : carrion : **animal that dies of itself: the original Arabic has a slightly wider meaning given to it in Fiqh (Religious Law): anything that dies of itself, and is not expressly killed for food with the Takbir duly pronounced on it. But there are execptions, e.g., fish and locusts are lawful, though they have not been made specially halal with the Takbir. But even fish or locuts as carrion would be obviously ruled out.

Moreover, According to the differnent schools of thoughts:

**Hanbaliy and Shafi’ee scholars: **All living creatures that live in the sea are halal, whether they are in the form of a fish or not. (Fiqh alal Madhaahib al-Arbaa). Oyster, oyster extract, shrimp, lobster and shark are all halal and permissible.
**
Maliki scholars: **Every living creature of the sea is halal except eel. Hence, oyster, oyster extract, shrimp, lobster and shark are halal and permissible.

**Hanafi scholars: **The only living creatures of the sea that are permissible are those that are in the form of a fish with an exception of the hagfish and eel (these 2 even though they are not in the form of a fish they will be permissible to consume). Hence, according to the Hanafi scholars, it will not be permissible to eat oyster, oyster extract, shrimp and lobsters. It will be permissible to consume shark as it is in the form of a fish.

If we see the context of Hadith then only the fish is permissible to eat.

How could a person be satisfied with a single date?” Jabir replied, “We realized the value of that one date when we could not even have that much till we reached the sea-shore, when all of a sudden we saw a huge fish cast by the sea. So, we ate of it as much as we wished for eighteen days.”

**Narrated Jabir: We set out in the army of Al-Khabt and Abu Ubaida was the commander of the troops. We were struck with severe hunger and the sea threw out a dead fish the like of which we had never seen, and it was called Al-'Anbar. We ate of it for half a month. Abu Ubaida took (and fixed) one of its bones and a rider passed underneath it (without touching it). (Jabir added:) Abu 'Ubaida said (to us), “Eat (of that fish).” When we arrived at Medina, we informed the Prophet :saw2: about that, and he said, “Eat, for it is food Allah has brought out for you, and feed us if you have some of it.” So some of them gave him (of that fish) and he ate it. **

In Holy Qur’an Surah Al Ma’aida verses 96, Allah SWT Said: “Lawful to you is game from the sea and its food as provision for you and the travelers, but forbidden to you is game from the land as long as you are in the state of ihram. And fear Allah to whom you will be gathered”.

and according the** book ‘Purification (Kitab Al-Taharah)’ of Sunan Abu-Dawud Hadith No. 0083**

** Narrated AbuHurayrah: A man asked the Apostle of Allah :saw2: Messenger of Allah, we travel on the sea and take a small quantity of water with us. If we use this for ablution, we would suffer from thirst. Can we perform ablution with sea water? The Messenger :saw2: replied: Its water is pure and what dies in it is lawful food. **

Some of these are ‘Makrooh’. Better to ask a scholars who know what they are talking about and how the rulings are derived from Qur’an and sunnah and when the vast majority os scholars agree on something, it’s much safer to follow them.
