Is 3 times divorce still valid when

If the husband said 3 times divorce to the wife on the same day which is against Sharia law how is de divorce still valid?!
Can the wife fight the triple talaq in sharia court?
Even if the husband says he's sorry he's done it now but he was calm and concious when he was doing it to her? How is it possible the husband can get away with it if the husband divorced the wife when he just had intercourse a few days before divorcing her? Surely that shouldn't be allowed?

I know that it is wrong to give all three in one sitting but it is still binding. I don?t see a (shariah) court ruling going against that. However even after giving 3 divorces in that way, the man is still responsible for providing for her in most circumstances for some time.

Let us see what the Holy Quran has in it, since their is a whole Surah named Talaak it is Surah # 65 and the Translation is by the scholar named Asad:

65:1 (Asad)O PROPHET! When you [SUP][1]](http://javascript:var%20winNote=window.open(%22shownote.asp?chap=65&note=1%22,%22winNote%22,%22width=500,height=500,resizable=1,scrollbars=1%22))[/SUP] intend to divorce women, divorce them with a view to the waiting period appointed for them, [SUP][2][/SUP] and reckon the period [carefully], and be conscious of God, your Sustainer. Do not expel them from their homes; [SUP][3]](http://javascript:var%20winNote=window.open(%22shownote.asp?chap=65&note=3%22,%22winNote%22,%22width=500,height=500,resizable=1,scrollbars=1%22))[/SUP] and neither shall they [be made to] leave [SUP][4]](http://javascript:var%20winNote=window.open(%22shownote.asp?chap=65&note=4%22,%22winNote%22,%22width=500,height=500,resizable=1,scrollbars=1%22))[/SUP] unless they become openly guilty of immoral conduct. [SUP][5]](http://javascript:var%20winNote=window.open(%22shownote.asp?chap=65&note=5%22,%22winNote%22,%22width=500,height=500,resizable=1,scrollbars=1%22))[/SUP] These, then, are the bounds set by God - and he who transgresses the bounds set by God does indeed sin against himself: [for, O man, although] thou knowest it not, after that [first breach] God may well cause something new to come about. 65:2 (Asad) And so, when they are about to reach the end of their waiting-term, either retain them in a fair manner or part with them in a fair manner. And let two persons of [known] probity from among your own community [SUP][7]](http://javascript:var%20winNote=window.open(%22shownote.asp?chap=65&note=7%22,%22winNote%22,%22width=500,height=500,resizable=1,scrollbars=1%22))[/SUP] witness [what you have decided]; and do yourselves bear true witness before God: [SUP][8]](http://javascript:var%20winNote=window.open(%22shownote.asp?chap=65&note=8%22,%22winNote%22,%22width=500,height=500,resizable=1,scrollbars=1%22))[/SUP] thus are admonished all who believe in God and the Last Day. And unto everyone who is conscious of God, He [always] grants a way out [of unhappiness],

  1. So were there Two witnesses present when he pronounced the divorce?

  2. Did he ask her to Leave the house right away?

So it is worth it to go to sharia court even if it means she can only fight for getting financial support from him?

No there were no witnesses present. Just the husband and wife. She doesbt know how many times he actually said 'Im divorcing you" or “you’re a divorced woman now” in the span of just 24 hours. It is more than 3 times.

she has no clue how long she can stay. They lived in his mamoo’s property and he is sleeping in opposite studio also owned by his mamoo only 2 meters away from where she lives. His mamoo might say that she needs to leave.
she has no one in the UK apart from a couple who used to live together with her and her ex.

But what about the fact that he divorced her only a few days after having had sex? She has fertility issues so chances of pregnancy are 0 but still he divorced her after having sex after her last menstrual cycle.

I suggest listening to the whole lecture as well as the Q & A session afterwards.
I don’t find anyone else knowledgable on Islam more than this man in today’s Pakistan (and beyond).
Suggest you listen to the whole lecture and following Q n A sessions which touch a lot on these issues

I’m not very knowledgeable about the condition of the sharia courts in the UK so I can’t really comment on this. In general I would say that it is worth going through legal process to get what you are legally entitled to.

This wouldn’t have any bearing on the legality of the divorce itself. If she was hypothetically pregnant, then her iddat period would be until the birth of the child. He would be responsible for supporting her for this time.

I’m telling you only from the most general perspective of how it would be viewed from a religious perspective. However, in terms of what are her options or what she could do, it would take someone well versed about her situation to suggest something practical for her.

I think it is very seroious issue you could cosult a Mufti and tell the whole story truly then he will you what is happened according to Sahria Islamic law..
