Under Hanafi fiqh, if an unmarried man dies, how is his wealth divided amongst his family? Both of his parents are alive and his only sibling is his brother.
Re: Inheritance under Hanafi Fiqh
EDIT: as i understand from verse 4:11, the mother will take 1/6 of the inheritance and the rest goes to the father....
the brother gets nothing....
Re: Inheritance under Hanafi Fiqh
Ok, under the above situation, what happens if:
a) The mother dies before the man, leaving just his father and brother alive
b) The father dies before the man, leaving just the mother and brother alive
c) Both the mother and father die before the man, leaving just the brother alive
Re: Inheritance under Hanafi Fiqh
Do you have to divide your money in that manner? What if there are mitigating circumstances, such as the brother needing the capital for busines?
Re: Inheritance under Hanafi Fiqh
Well, I wouldn’t know mitigating circumstances at the time. The man is me, and I need to film in paperwork determining how the stock I hold in my employer will be divided when I die.
Since my family loosely follows Hanafi fiqh, I figure i may as well have the stock distributed by that fiqh’s rules.
Re: Inheritance under Hanafi Fiqh
a) the brother still gets nothing, the father takes all
b) the mother takes 1/3, the brother takes 2/3
c) obviously the brother gets all
Re: Inheritance under Hanafi Fiqh
^
i am no expert in inheritance things....
just telling u what i derive from Quran....
very well possible that i am wrong....
Re: Inheritance under Hanafi Fiqh
Well that's more than I know. If I find out that this is wrong, then I can always fill in yet more paperwork and get the beneficiaries and proportions changed.
Jazakallah Khair :)
Re: Inheritance under Hanafi Fiqh
Read Surah Nisa...the opening Ayah's are pretty much to the point.
