To those of you who have not heard about the case here goes. Imraana was allegedly raped by her father in law. The Indian courts have convicted him for this crime. Now the Islamic leaders are up in arms against Imraana staying with her husband saying that Imraana should treat her husband like her son since it was proved that she was raped by her father-in-law.
I have a few questions for the posters here

  1. Does’nt Islam make a difference between consensual sex and rape. Isnt Imraana being punished for no fault of hers
  2. Why are the muslim leaders who shout on the roof tops regarding where Imraana should stay silent on the punishment for her father in law. True he is being punished by the courts. But why no fatwa.
  3. Isnt this a travesty of justice.
  4. Who should get custodial rights for the children. If you look at it from a differnt perspective, her children are like her grandchildren since her husband is her son. So does the husband get custodial rights on the children. Wouldnt this open a can of worms.

A son’s wife is like a daughter to the Father in Law, this guy commited rape and incest, Sons can not be punished for their Father’s crimes simple.

fiqh says that she shud be separated from her husband after such an incidence....
many laws of Allah r above human understanding, and if u dont understand the reason behind the rule, it doesnt mean u go out against it....
if u want to follow Islamic Shariah, then the rule is separation from the husband....

Can you please provide evidence from Quran and Hadith? I haven't followed this case and not familiar with the ruling.

The girl was raped with no fault of her own. and now she has to suffer cause no one will marry her because of the culture. and now she has to get a divorce from a husband who is willing to keep her. am i missing something here.

This is very sad and strange story did this type of incidents occurred in the passed as well? Father in law raped his daughter in law (Asthfar)

As far as i knopw this is only according to Maliki Fiqh that she shud be separated from her husband. According to Hanbali Fiqh she need not be separated.

Fiqh is for humans, and has been codified by humans...so to suggest it is above our understanding is simply wrong.

It is not cler at all that she should be seperated from her husband since her father in law raped her. There is a difference of opinion on this matter, and as such it is subject to our full scrutiny.

i am truly disgusted at the fatwah if it is exactly the reason for separation. I cannot believe it simply. absurd to the hilt.

Incest or not, Rape is not sex, the punsihment for rape comes under opression (Fitna) not adultery, neither the victim is considered to have commited adultery. How on earth these mullahs order such a fatwa. i would like to see the fatwah of imam malik on it and clear rationale behind separation.
