So someone has had their green card for about five years through court. They were sponsored by an employer. Last year around August they applied for their citizenship and went through the whole process of interviews and tests. It had been five months and they haven’t received any oath letters so they go back to check their application status.
The immigration folks tell him his labor certificate has been transferred to someone else by their employer, now since that other person has gotten their green card, this person’s green card can be cancelled.
How is this possible!? Anyone here who can offer any sort of advice over this? They still have to wait for their official letter from the immigration before they can contact a lawyer, so if anyone here knows anything about sponsorship laws can make this week easy?
how did they hear from the immigration folks before the letter? once a green card has been issued, i don’t see how that person’s labor certification is even open to be assigned to anyone else, whatever that might mean. sounds really weird. i would ask the attorney he used for the gc process right away, if the information is legit, why wait?
i think once someone enters the country legally and has a permanent residence status [green card] it can NOT be revoked until and unless that person commits a serious crime. the green card should NOT be linked to employment after he/she has been granted permanent residence.
He’s been going over to the immigration office every month to get an update on his case. Up until last month the person who was handling his files was on some ‘vacation’ so they couldn’t update him. He went today and was told to forget about his citizenship process, he needs to worry about his green card because his labore certificate has been used by someone else, which in return can cancel his greencard.
He contacted his lawyer but the lawyer wants to wait for an official letter from the immigration before he can tell what’s going on.
So a green card being revoked by an employer after five years isn’t possible?

so either the immigration situation is diff than what is shared or something else is going on.
btw, mememe, instead of waiting for an official letter, which they should get anyways, the dude needs to take his damn lawyer with him next time, because if some jackass is dickin around, the lawyer being there will be a deterrent. and if his lawyer does not want to go and wait for the letter, then change the lawyer, because when unusual crap happens, you have to be more active.
Is it possible that the use of the labor certificate by someone not authorized to do so is considered a criminal offence and therefore the green card status is in jeopardy?
