He is gone on a trip and disappeared, or ran away from you without giving you divorce …
then according to some books, you have to wait till his age reaches 90 (so you know that he is probably dead) before your can remarry.

Is there an ijtehad on this ruling or its still the same?

I think she has to wait till few years ... if he appears then fine if not then she can marry someone else .....

See this situation and associated fatwa is so relevant to the current situation of Pakistan, which made me think if we have the exact ruling in hand.

People in Pakistan disappear everyday. For how long, wife of Shahbaz Taseer has to wait? What about all those people that disappeared during Musharraf's time? For how long their wives should wait. Similar thing happened in Zia's time when people were going for Jihad, only to never come back.

I think in this day and age, where world is so globally connected, and messages can be reached from one end to the other in the blink of an eye, even four years is quite a long period.

It might be possible for a woman to get khula in abstentia of husband ... in order to expedite marriage to someone else ... so long as the iddat period has lapsed - which assuming it has given the question ... but if the woman only wants to marry anew if she becomes widow and not divorcee then she will have to wait until confirmation of her husband's death or whatever duration until it is considered an absent time equivalent of him probably being dead.

I heard that too that it might be possible for a woman to get khula if husband is long gone, but I dont think that the ruling is universally accepted by all the Ulema. Majority is still on the side of making her wait till its sure that husband is dead.

Different position for different fiqhs, i remember reading about it, according to some its 2 years, other 4 years and if I can remember correctly, there is a saying of Ali r.a t=about some years and that it would be better if she can wait till he comes back or death is confirmed.

I don't think the iddat period would be relevant to this situation... Unless there is certain proof of his death, the woman would not be considered a widow.

I would assume she could file for khulla to seek the dissolution of her marriage on the ground of his disappearance through the Shariah court.
