I want to know some things, can anyone help me?

i need to know if there is a property, which is owned by 3 brothers and 2 sisters.. The 3 brothers and 1 sister are agreed upon selling it but one sister is not.. is it possible to sell a property like this? or are there people or institutions available who buy your share?

i depends which country you are in and to some extent which state/province you live in. the laws vary but i think ALL the parties have to agree to sell...the court may offer her to buy by the property herself by paying her brothers and sister. this is an amicable compromise which allows her to have house and the siblings to get the cash they are looking for.

I dont know about the paper work, i just know that its on all 5 siblings names.

the issue here is that we are in deep financial trouble, we dont have money to spend on our expenses. previously a relative was helping us out but now that is also not an option. a very good property offer came which is not acceptable to my aunty. she wants more than double the offer. only then she will agree to sell.

I dont know what to do to make ends meet. my father is old and can't work. we have no savings. i work but im only paid a low amount as my studies are not complete. I don't know how to earn more. and my aunty is stubborn and doesnt care about anything else. please tell me what to do?

paper work is on siblings name. previously on their dads.

what usually happens is......... you pay the minorty right holder their right ......and in this case...you can give her twice her share ..so that she agrees..........

Brilliant idea. That would work. But more importantly seek out someone with a background in Pakistani Property law because it is convoluted and difficult.

so if shes gettting one, we give her 2 right? but that would make our share half.. that wouldnt be enough for us to survive forever as this is the only piece of property left. rest of the property left is low valued

I told my dad we will beg her but hes too egoistic. so my sister politely talked to her.. and hes not bothered about my dads health. our weddings. our studies.
how can someone be so .. selfish?

You guys would have to deal with it internally then. We can not give you any proper advice because we are not lawyers and we are not your family.

going down the legal route is always troublesome........courts, laywers and patwaari n whatnot......its really messy...........the best option is to bargain with the refusing aunty........ and try to work out some compromise........... if she isn't agreeing......u need to offer her more......try to get her to agree at as lowest as possible.......

PS: sorry to be offensive.......but get some guy to handle it.........

As CM has stated, Nom's idea is excellent.

There are 5 siblings. each gets 1/5. If you give this lady 2/5, you split 3/5 among 4 or 0.15. So you dont get half of before - you get 15/20 or 75% of before. Not as bad as you thought.

Well there are two ways of dealing it ... persuade her to the agreement - as if she goes to the court and file a case - then even an average lawyer can make your lot wait for 8 to 10 years - till you get a decision in your favour ..

Second option is - try to talk to estate agents - they know the system inside out - you may not get the expected value of your property .. but they can offer you enough amount and then it is their headache to deal with your aunt.

And if you are in karachi - Go to Union council office / Sector office ( MQM) of your area - file an application - they might call both parties and help you reaching a decision ..

Or if you want it by hook or crook - get one of your aunt's kid kidnapped - put a Beretta 92 on his/her head and make your aunt sign those papers for you ..

kia karhaiN - ganda hai Par dhanda hai yea and that's how disputed property matters usually get dealt in Pakistan :D

Either try and resolve the matter internally within your family. If that doesn't work, please seek proper legal opinion on the matter. This is NOT the place for guidance on serious legit matters.

Maybe your aunt is looking for some respect? I am not saying this is true - but consider that possibility. Sometimes it is abour respect, not money
