The Islamabad High Court has ordered the suspension of Zaka Ashraf, the head of Pakistan’s cricket board, over what it called the “dubious” and “polluted” process to elect him.

Ashraf, the PCB chairman, was ordered to “refrain from exercising his power within his incumbency” till the court’s next hearing on June 13.
The court was responding to a petition filed by a former Rawalpindi Cricket Association official against the Pakistan board’s elections that were held earlier this month - through which Ashraf was elected to a four-year term as chairman.
“The petitioner has a good arguable case in his favour, as entire process of election of PCB chairman Zaka Ashraf appeared to be motivated and polluted,” Justice Shaukat Siddiqui said.

PCB’s legal representative Tafuzul Rizvi in response told ESPNcricinfo that the board will assist the court during the next hearing. “We will present the facts before the court and after that any decision will be followed in letter and spirit,” Rizvi said.
The board of governors meeting and the AGM that was scheduled to take place in Karachi on May 28 and 29 has been postponed in wake of the court’s decision. The board however will continue to function without a chairman in the interim.
In more bad news for the PCB, five top regional associations - Lahore, Karachi, Multan, Faisalabad and Sialkot - have also revolted against Ashraf, alleging a fallacious electoral process. The five associations, presently dismissed by the PCB, constituted an interim committee to run the city associations.
There are two more petitions relating to the election pending against the PCB - one in the Lahore High Court, and the other in the Sindh High Court that was filed by former wicketkeeper Rashid Latif. The petition in the Sindh High Court is scheduled to come up for hearing on Wednesday.
Ashraf was elected in the first week of May, under the new PCB constitution that replaced the system of appointing the PCB chairman by the patron of the board, the president of Pakistan. It was the first election of a PCB chairman.
He was one of the two candidates - the other being former Lahore Stock Exchange chairman Aftab Ahmad Khan - recommended by the patron and then interviewed by the nomination committee. The committee then unanimously recommended Ashraf for the chairman’s post, before the board of governors unanimously endorsed him.
As per the new constitution, the board of governors was restructured to include ten members - five regional representatives on the basis of rotation and five representatives of service organisations and departments - with voting rights. Of the ten, PCB was able to appoint nine, all of whom voted in favour of Ashraf’s nomination. However, there was no representation from Punjab, Pakistan’s largest province with 60% of country’s population, while two new regions without any first-class team - Larkana and Dera Murad Jamali - were drafted in to the board.
The process was conducted without any prior announcement, the PCB revealing the appointment through a press release.
The PCB’s new constitution was produced as a result of the 2011 ICC directive, which required that its member boards become autonomous and free of interference from governments by June 2013. Removal of government interference had also been one of the Woolf report recommendations approved by the ICC. However, in November 2012, the ICC said it was reviewing its stance against government involvement in the administration of cricket.
Ashraf has been the PCB’s chairman since 2011, previously working under the old constitution, under which he was appointed for an indefinite period by the patron, President Asif Ali Zardari.

The Islamabad High Court has upheld the suspensionof Zaka Ashraf and ordered the Pakistan inter-provincial committee to name an interim PCB chairman to represent the board in the ICC annual conference in London later this month. The detailed order is awaited and is likely to be issued later today. The next hearing on the matter will be on June 19.

Ok so what ever the reason, the sudden removal and subsequent delayed replacement has put the whole PCB into a whirlpool of inaction.

The crisis in the PCB surrounding the suspension of Zaka Ashraf as chairman is having its deepest impact on the team’s tour of the West Indies in the middle of July, starting with the memorandum of understanding between two boards and the selection of the team. It has also led to a delay in the PCB budget this year that, among other things, could affect salaries and player contracts.
The suspension of Ashraf has also led to an impasse in the board, with officials saying it is not possible for key decisions to be signed, be it the MoU with the WICB or the search for the home broadcasters. Ashraf’s suspension is now being argued in the Islamabad High Court, which on Wednesday once again ordered the government to name an interim PCB chairman within three days and report on the next hearing on June 24.
In a third hearing of the judicial petition against the PCB’s new constitution, the court decision left the board’s major activities on hold. This uncertain status at the top could make its first dent at the ICC’s annual meeting next week, as Pakistan along with other Full Members are due to give their response to the ICC guidelines about decreased government interference in cricket administration.
The PCB constitution allows its chairman near-absolute powers, making it almost a one-man show. Under the PCB constitution, the PCB chairman is also the chief executive officer and every major decision needs his approval - effectively giving the post of chief operating officer very limited powers.
The PCB was undecided about who will represent them at the conference, starting June 25. In 2011 the ICC had given a two-year deadline to the member boards to democratise their constitutions and remove government involvement in a bid to improve governance. Even though the ICC had relaxed its clause about the role of governments and the PCB tweaked its constitution slightly under Ashraf’s chairmanship, the current situation is bound to raise concerns.
When Ashraf became the first incumbent elected president for another four-year term in May, it was the first such appointment under the new constitution. The IHC, however, ordered Ashraf’s suspension, citing the election process “dubious” and “polluted”.
The court, however, had not suspended the new constitution. The petition against the PCB was centred on the amendments made in it, especially those pertaining to the election of the chairman.
A government lawyer Irfanullah informed the IHC that former Pakistan captain Majid Khan was among three candidates for the role of acting chairman, and their names have already sent to the Prime Minister - who will make a final call. The commentator Chishty Mujahid and former chief of the Federal Board of Revenue Mumtaz Haider Rizvi are the other candidates.
The revised constitution also restructured the composition of the board of governors. The new 14-member body included five regional representatives selected on a rotation basis, five representatives of service organisations and departments, two non-voting former cricketers appointed on the recommendation of the chairman and two non-voting technocrats picked from a panel of three recommended by the chairman in consultation with the President of Pakistan. The term of each member was to be one year, but large regional associations like Lahore and Karachi along with Sialkot, Faisalabad and Multan are keen to have a permanent role on the board.
