well its many things at the same time
its child molesting
its a rape
and its a hate crime
all of these are horrible crimes, and the perp should be tried under any and all counts here.
I agree its is wrong to generalize the issues to all hinhus. Well is a sad case. While readind the news something that caught my attention was that the event happened at 9:45 pm, in the bathroom located in basement area. What was that girl doing there anyway? How did she get to the basement at that hour? Was she a worker there?
Yeh she was an employee there.

In P.A. case, hate crime charge is not filed
MAN ACCUSED OF ASSAULT WITH INTENT TO RAPE

Prosecutors charged an East Palo Alto man Thursday with assault with the intent to rape a 15-year-old girl at a Palo Alto drug store last week, but they did not charge him with a hate crime.
Palo Alto police reported that the suspect, 18-year-old Sanjay Nair, who is Hindu, made comments before and during the alleged assault of the Muslim girl that prompted officers to book him on both rape and hate crime charges.
``We don't believe that was the substantial motivation for that attack,'' said Assistant District Attorney Karyn Sinunu, explaining why the charge was not filed.
Furthermore, she said the decision to charge Nair with assault with intent to rape instead of rape was based on what the evidence supported, but she would not discuss specifics of the ongoing case.
Sinunu said that Nair did have discussions with the girl about her being a Muslim and ``they weren't positive discussions.'' But she would not elaborate on those comments.
Palo Alto Police Chief Pat Dwyer said he would not second-guess the prosecution's charge. But then he said the evidence seemed clear to him, though he also declined to provide specifics.
``Our interview with the victim indicated that there was a history of remarks denigrating her religion made to her by the suspect and that also her statement to us was that during the alleged sexual assault remarks were made about her religion.''
Nair is expected to be arraigned today. He could face six years in prison, if convicted.
At 10:45 p.m. last Friday, police say the girl was assaulted by Nair, who was working at the Longs Drug Store on University Avenue, in the store's basement bathroom. Sinunu declined to describe the details of the attack, other than to say that the girl reported she was taken by surprise.
Further investigation and testing of evidence is still going on, Sinunu said.
Nair's family and friends said the teenagers had dated and that any sexual conduct was consensual. Police have said they do not have evidence there was a prior relationship.
The Mercury News is not naming the girl because of her age and the nature of the alleged crime. Attempts to reach her family for comment have been unsuccessful.
The hate crime allegation reported by police soon after the attack generated interest from a variety of groups, including about a dozen whose representatives gathered in front of the Longs on Wednesday for a news conference to condemn what they called a ``hate rape.'' They also called for authorities to prosecute to the fullest extent of the law.
I'm disappointed,'' said Manzoor Ghori, chairman of Indian Muslim Relief Committee.The Palo Alto police investigator had determined, and he has no doubt in his mind, this was a hate crime.''
Ghori and other leaders of the South Asian Muslim community had met with the Palo Alto police chief and the investigator Wednesday morning, just before the conference.
``Are you sure it's a hate crime?'' Ghori said he had asked the police.
They would not be charging if they weren't 100 percent convinced, Ghori said the police told him.
Nonetheless, Ghori said he understood why the district attorney would not seek the hate crime charge.
``I am told it is not easy to prosecute or prove hate crimes,'' Ghori said.
Nahid Sheikh, who works for Narika, a women's advocate group working in the South Asian community, said any assault on any human being is a crime.
It's still a violent crime,'' Sheikh said.Whether the police charge it as a hate crime, it's still a misogynist crime.''
Sonya Pelia, president of Maitri, a Bay Area women's advocate group, added: ``The entire community was galvanized because of the possibility this was a hate crime. If it's proved to be a case of assault and not hate crime, we hope the community will not withdraw support for the victim and her family.''
If Nair were convicted of the hate crime, he could have faced up to three more years added to his sentence. He is being held on a $20,000 arrest warrant at the Santa Clara County Jail in San Jose.

An 18-year-old woman from Meerwala in Punjab province, was sentenced to being raped in 'punishment' for her 12-year-old brother's alleged 'illicit affair' with a girl from a tribe considered 'higher' than his, the Mastoi tribe. There are reports that boy was sodomized to punish him for his 'offence' immediately after he was found walking in the company of the Mastoi girl.

This guy is a Hindu from FIJI. And also this case has been blown out of proportion by the media since it was a Hindu-Muslim affair. Pre-Sept 11 it would have been a regular "sexual assault". The boy's mom quoted her son as saying that the sex part was consensual.... so dont rush to judgement just yet...
