An eight-member bench of the Supreme Court of Pakistan, headed by Chief Justice Abdul Hameed Dogar, Monday admitted for hearing a couple of petitions challenging the imposition of emergency in the country and issuance of the Provisional Constitutional Order (PCO) 2007, on November 3.
Iqbal Tikka, a former PPP leader from Punjab province and Wattan Party of Pakistan, filed the petitions.
After hearing preliminary arguments, the bench issued notices to the President, Chief of the Army Staff, the Federation of Pakistan and Chairman PEMRA for regular hearing from November 15, said a court official.
Declaring the imposition of emergency as unconstitutional, petitioner Iqbal Tikka contended in his petition that the Chief of Army of Staff was not authorised to suspend the clauses relating to the fundamental human rights and it was the sole prerogative of country’s President, official further said.
The petitioner also said that the Army Chief could neither proclaim emergency nor impose restrictions on media or media persons.
Wattan Party also denounced the imposition of emergency and asked the apex court to strike it down.
Notices were issued to respondents namely President, Chief of the Army Staff, the Federation of Pakistan and Chairman PEMRA, to file reply and adjourned the hearing till Thursday. Attorney General was also directed to assist the bench on next hearing.
