it depends how much you have had to drink and what your stamina is as well, as far as heroine goes it makes u really hyper, it makes u really aggressive, so yeah ....... doing things while drunk well all that happens cuz different ppl act differently, some ppl loose control of their brain before body and some do it the other way.

The articles don't really explain the underlying circumstances.
What is clear is how it was presented to the jury and judge for conviction and sentencing. On one hand, she was not guilty of first-degree murder because premeditation could not be proven. So instead they went for a lesser charge of manslughter. The jury agreed that she was guilty of acting in the heat of the moment and that her actions caused the death of the other individual. Even if she pleaded self-defense, the jury did not accept this defense to excuse her actions and did not fund her "not guilty" of manslaughter.
It is within the judge's discretion to sentence according to certain guidelines. If he felt that there were extenuating circumstances that warranted a suspended sentence he was well within his right to make such a determination. Keep in mind - she was found guilty and will carry the conviction on her record. I'm not familiar with UK sentencing guildelines, but stateside, manslaughter convictions can get a range of sentences (depending on the jurisdiction) and the surrounding circumstances that are presented at the time of sentencing.
It appears your objection is to the sentence she received - and truth be told it's not that unusual.
No my objection is not to the sentence she received… I probably would have been even more shocked if she got a death sentence or something! What I find shocking is a sister stabbing her brother to death… :sighh:
Sehrysh I see what u r saying but if you go by what the article says it looks like self defence to me, however i am sure something more was presented in court
The article implies that her brother "falsely imprisoned" her - that he restricted her ability to leave the house. The question then becomes - did she also fear for her life? Again reading just the article, it implies that she herself was not struck or hit by her brother, added to which she brought the knife with her which invites the question - for what purpose? So if she cannot assert that she feared imminent harm to herself, than the self-defense argument is weakened.
There's another argument such as the one presented by battered women who kill their husbands, including those that kill with premeditation. Again, each jurisdiction is different, but in many cases the woman can cite patterns of violent behavior against them and that the killing was in response to years of abuse. It may be that the sister and her family presented examples of prior incidents of violence by the brother to support her request for a lesser sentence - again pointing to the pattern and her reasonable fear.
No need to scratch your head - when you are drunk or high on pills, your brain cells reacts to the way you actually think .. if you are a violent person from the get go, chances of you being a brute is much higher than anything, that’s what hallucination does to you … but if you are non violent person, no matter how drunk you get you wouldn’t be hurting anyone.
