Father gets death penalty for rape, fatality of child Staff Reporter/ New Delhi
In a rarest of rare judgements, a city court on Friday awarded the death penalty to an accused for raping and being responsible for the death of his three-year-old daughter. The complainant in the case was the wife of the accused, Rabia.
Accused Mohammad Sheikh Noor Hussain has been convicted under Section 302 and 376 of the Indian Penal Code.
The incident occurred near the cement godown at Safdarjung Railway station in Netaji Nagar in 2002 where the accused lived with his family.
On June 6, 2002, when Rabia, the wife of the accused returned from duty she found her daughter weeping loudly and her husband standing naked on the other side. When Rabia questioned her husband, he ran away from the spot.
Thereafter the child was rushed to Safdarjung Hospital for a medical examination and the police informed. Rabia recorded her statement before the police after which an FIR was registered against the accused under Section 376 of IPC at Sarojini Nagar police station. On the same day, the accused surrendered before the police and confessed to raping his daughter. A medical examination of the accused confirmed that the facts.
The same day, the child died after which the police converted the case under section 376/302 of IPC and filed a chargesheet accordingly in the trial court.
The prosecution examined a total of 19 witnesses in the case. Additional Session Judge SK Kaushik said in his observation, “Considering the facts and circumstances of the case, I am of the view that the present case is the rarest of the rare cases requiring the sentence of death.”
