Child custody...that would be interesting. It's a very real dilemma here in the US..when a same sex couple has a child through in vitro fertilization, the child biologically only belongs to one. The other "parent" often times finds themself SOL if the relationship sours.
More like creating a child to begin with. I think they have to break same-gender law to get
one of those.
No. There is nothing illegal about same sex couples hiring a surrogate mother or using a sperm donor. Other then adoption, that is how same gender couples start families of their own.
When I was going through fertility treatments myself, I met a same sex male couple who were having a baby with the help of a surrogate mother. My doctor used the sperm of one of male partners, they got an anonymous egg donor, and implanted in a surrogate mother who carried the baby to term for them. There plan was to do a second round two years later with the same surrogate mother, but use the sperm from the other male partner that time. So each man would have a been the biological father of one the children. This was about 13 years ago before same sex marriage was legal in all 50 states.
So the dilemma I'm proposing to nadz to debate would be if that couple splits up, after raising the children together, would the partner who was not a biological parent have any custody claims?

hmm...
I think its one of worst exploitation of a woman. But a kool one.
PS: I meant by gender-law, as they think its law of nature that they are same-gander couple.
