FATA Jirga system is great for resolving local disputes such as: murder, theft, rape etc. However it has understandably failed to face the global onslaught of terrorism.
Terrorists seem to be using very sophisticated military and psychological warfare in the FATA area.
It is really heartening to see that that FATA people are actively working with Pakistani Army in eradicating MAToo menace.
I have respect for their local tribal laws but what is needed today more than ever is that these areas and people be asked to respect state laws. There is a need to bring them into the mainstream national life and for that it will be important to gradually replace the jirga laws with the muncipal laws.
From what I know of the Jirga system it is democracy in its most basic form. A group of people elect an "elder" or a "president" who presides over the meeting. This group then works collectively to figure out the problems and how to solve them. Very much like the senate or any legislative body. Then they implement the judgment they have decided to implement after a collective agreement, however the "elder" or "president" has some extra or additional powers to influence the final judgment. Very much like the power a leader has over the legislature and judiciary.

FATA areas do want to observe state laws. The problem is with the terrorists who have gotten hold of peaceful Pakhtuns. These terrorists are using Pakhtuns as human shields. Arra-bobo MAToos used the human shields pretty regularly in other parts of the world.
