The qawwali was revamped with the voice of Adnan Sami Khan for the Salman Khan-starrer and went viral soon after its release. However, it received mixed reviews, with many finding it bland owing to the incompatibility of Adnan’s sweet vocal texture for something as raw as a qawaali. But a legal battle by the qawaali’s original producers that has followed its release makes the quality of the soundtrack a rather trivial matter.

**Pakistan’s biggest record label EMI Pakistan and Amjad Sabri qawwal, heir to the famous Sabri brothers, have called for legal action against the producers of the film and the qawwali in separate instances.

“Revamping the qawwali without my permission or consent is simply unethical and inappropriate,” Amjad Sabri told Roznama Express. “This is not an ordinary Kalaam; it’s the property of my family and will continue to be so for the coming seven generations. This is an asset of my father Ghulam Farid Sabri and my uncle Maqbool Sabri.”

The version used in the film has been reworked by well-known composer Pritam Chakarborty and the film is being produced by Salman Khan Films and Kabir Khan Films.

Amjad is not only unhappy by the work ethics of the Indian producers but is also disappointed at the quality of the Bollywood version of the qawwali. “They have not done justice to the heritage of our elders and I have hired a lawyer to sort out this matter,” he said.

EMI Pakistan, on the other hand, are all set to send separate legal notices to Salman Khan Films and Kabir Khan Films, Media Concepts (the company responsible for airing the film’s music in Pakistan) and also to 8xM and Jalwa music channels, which are subsidiaries of Media Concepts.

“The Qawwali Bhar do Jholi is an EMI product which was not only released by EMI Pakistan but also recorded and produced under our banner. None of the authorities involved in the making of Bajrangi Bhaijan approached us to acquire the rights to the qawwali and as a result, we have sent them legal notices,” Zeeshan Chaudary, the general manager of EMI Pakistan, told The Express Tribune.

As per the details shared by the record label, the “original” qawwali was written by Purnam Allahbadi, composed by Maqbool Sabri and performed by Sabri Brothers for the purpose of recording a soundtrack in 1975.

“We have the rights to the complete recording of the original qawwali and its derivatives and neither Adnan Sami Khan nor the producer of the music or anyone else has acquired rights from us,” he said.
If both EMI’s and Amjad Sabri’s claims of possible copyright infringement are to be believed, it would benefit both parties to sort out the actual ownership of the qawwali before spiraling into a blame game.

“Amjad Sabri cannot claim the ownership of the Qawwali and we have the legal documents to prove that,” said Chaudary.
“He can only do that either by showing us the last will of his father, which ensures the inheritance of Ghulam Fareed Sabri’s intellectual property to his son or he will have to get a succession certificate as per the laws of the country. If he is able to do that, then he will also receive the royalties, as per the agreement with the original artist,” he added.

Chaudhry further elaborated that this applies to all cases wherein the children of any artists wish to claim rights to the artist’s intellectual property.
As for now Bajrangi Bhaijan is all set to release along with Bin Roye in Pakistan on Eid.

Amjad Sabri Not Happy With The Pakistani Media

Like many other celebrities of Pakistan Amjad Sabri is also not happy with Pakistani media because he feels that Pakistani media always highlights the negative trends pertaining to a celebrity’s life instead of the positive ones. Amjad Sabri shared his feelings about this negative trend in the media when he was part of Maya Khan’s Ramadan Transmission.
Amjad Sabri said that he had taken legal action against all those involved in making the Qawwali “Bhar Do Jholi Meri” a part of Salman Khan’s latest Bollywood flick “Bajrangi Bhaijaan”. This Qawwali was originally sung by Amjad Sabri’s father Maqbool Sabri along with Ghulam Farid therefore he feels that being his son his permission should have been taken before anyone decided to sing this Qawwali in a film. He also said that no credit was given to his father and he also did not like the changes which were made in the Qawwali to make it fit in the film.

Amjad Sabri said that the Indian media was highlighting this issue but the Pakistani media was only praising the Qawwali sung by Adnan Sami Khan and not talking about the legal technicalities involved. He said that the leading newspapers of India like Indian Times were contacting him day and night so that they could learn about the latest developments in the case but none of the Pakistani newspapers or channels had contacted him. Amjad Sabri said that the media should set its priorities straight and learn what they really should be focusing on. Maya Khan who is hosting the Ramadan transmission on TV One promised the Qawal that she will highlight this issue even if no one else was going to do it.

Bhar do jholi ya Muhammad is copyrighted work of Sabri Brother. India can not use it until 2025. After that they can use it without permission. **

Pritam , the original composer, did not copied whole Naat, he took Bhar do jholi ahsar from Naat.

Daughter of Sabri praised Adnan Sami Khan on different raags and fusion.

I think the right thing to do would have been contacting Sabri to sing it for the movie.
I would like to see what comes of this though - the movie is all set to release. I dont think they can't remove it this late. most likely some sort of monetory reimbursement.

Only an unethical "industry" like bollywood would steal others stuff and pass it off as their own original work. na koi sharm na apology. it's not about money ke compensation de do and everything will be alright it's downright unethical and disgusting no matter what.

I don't know why the general consensus is that Adnan Sami Khan has done justice to the Qawwali. Dude's enunciation is too burger and it is painful hearing him strain his clearly sub pa vocals on the high notes.

It has bee en happening for years but smaller record labels found it difficult to take legal action due to the costs involved. EMI Pakistan is well-established and have copyright on all their songs...I'm curious to know what happens next!

Adnan sami is a poor singer. Actually, it was Syed Noor who gave him a break in Sangam and provided him the platform to launch his career. It was an excellent film. Being an opportunist he doesn't even acknowledge Noor's contribution.

EMI is a big well established name. It doesn't need to cash in on some third grade bollywood crap. such unethical practises are expected of adman sami who used zeba bakhtiar and syed noor to launch his career in india.

adnan sami is a big fraud. he literally kidnapped his son an and ran away to canada against law. canadian authorities caught him and recovered the child from this haathi

He did not even acknowledge Riaz ur rehman sagar's contribution who used to write his songs.
