sorry, more important than the constitution is the safety of pakistanis. pakistan is under attack by jehadis and govt's responsibilty is to tackle the threat. govt cant fight this fight with both hands tied behind its back as done by supreme court.
is this because of the judiciary that the soldiers are surrendering to jihadis en masse?

yes blame lies on musharraf squarely for terrorism. he is too much of a softie nor did he tackle terrorism until prodded by the goras even though terrorism was a problem for pakistanis before 9/11. even after 9/11 mush has been slow to act even though he had full authority. the buck stops with him.
i would have been happier if army had overthrown musharraf along with judges and leading politicians. right now though neither the judges nor the politicians can tackle jehadis. until such time as credible opposition to mush arises, he is the best bet.

Supreme court did not stop Musharraf to take destroy and kill fanatics. Rule of Law does not prohibit the safety of anyone.
The only reason Musharraf declared emergency is that his presidency was going to be declared unconstitutional by the Court as per the law.
Musharraf and Army generals around him are desperately fighting to hang on to power, with no regard to people of Pak and their rights.
Anyone who acts against Law is an out-law and a criminal.

what he is doing is creating a situation where he is the only alternative to the taleban. you either support musharraf, or you're with the taleban BECAUSE they're the only persons left in the country who he hasnt deposed (and is pretty much doing nothing against).
so you cant remove musharraf because theres no-one else, no other institution left.

i would have been happier to see army overthrowing musharraf because clearly he now has too much baggage to provide effective leadership against jehadis. i think the army leadership below musharraf now is comitted against jehadis which was not the case when 9/11 happened. however given that pak army is a disciplined organisation, i dont see army acting against its chief. i think musharraf will be asked to leave a couple years down the road by the army.

Funny thing is that Musharraf and Army generals themselves created Taleban in the first place. They still have people in govt. who support Taleban, for example Shujaat Hussein and Pervaiz Elahi.

Pakistan’s Musharraf imposes emergency rule

ISLAMABAD (Reuters) - Pakistan President Pervez Musharraf imposed emergency rule on Saturday, deploying troops and sacking a top judge in a bid to reassert his flagging authority against political rivals and Islamist militants.
Nuclear-armed Pakistan’s internal security has deteriorated sharply in recent months with a wave of suicide attacks by al Qaeda-inspired militants, including one that killed 139 people.
State-run Pakistan Television said Musharraf had suspended the constitution and declared an emergency, ending weeks of speculation that the general who seized power in a 1999 coup might impose emergency rule or martial law.
U.S. Secretary of State Condoleezza Rice, on a visit to Turkey, criticized the measures as “highly regrettable” and said she hoped Pakistan would have a free and fair election in January as promised.
Witnesses said troops were deployed at Pakistan Television and radio stations, and most phone lines were down. Other troops sealed off the thoroughfare where the presidency building, the National Assembly and the Supreme Court are located.
Shots were heard in several neighborhoods of Karachi, where there is strong support for former opposition leader Benazir Bhutto, a former prime minister.
Television channels said that Supreme Court Chief Justice Iftikhar Chaudhry, whose earlier dismissal in March marked the beginning of a slide in Musharraf’s popularity, had been told that his services were “no longer required.”
Chaudhry had been reinstated in July.
Musharraf had been awaiting a Supreme Court ruling on whether he was eligible to run for re-election last month while still army chief. The court had said on Friday it would reconvene on Monday and try to finish the case quickly.
Chaudhry and eight other judges refused to endorse the provisional constitutional order issued by the president.
LAWYER ARRESTED
Aitzaz Ahsan, president of the Supreme Court Bar Association, told reporters at his home he was being arrested.
“One man has taken the entire nation hostage … Time has come for General Musharraf to go,” he said. Fellow lawyers shouted “Go Musharraf Go” as Ahsan was taken away by police.
The move is expected to put off parliamentary elections due in January, although Pakistan Television said that the cabinet, national and provincial assemblies would continue to function.
A senior security official told Reuters that Musharraf would seek approval for the move from the cabinet later, after which there were expectations he would address the nation.
The cabinet was due to start meeting at 7 pm (1400 GMT).
Musharraf had said he would quit as army chief if he was given a second term, and he had allowed Bhutto back into Pakistan to lead her party into the national elections.
A suicide bombing killed 139 people on Oct 19 when thousands of supporters flocked to the streets to welcome Bhutto when she returned to Karachi from eight years of self-imposed exile. She had flown to Dubai on Thursday.
Bhutto’s husband Asif Ali Zardari said she was already on a flight back to Pakistan from Dubai. He described Musharraf’s move as “definitely not pleasant news.”
“We’re hoping to build institutions, not destroy them.”
Exiled former Prime Minister Nawaz Sharif, deposed by Musharraf in the 1999 coup, described his decision to invoke emergency powers as a form of martial law.

“We are heading towards a chaotic situation, heading towards anarchy,” Sharif told Indian news channel CNN-IBN in an interview replayed by Dawn Television in Pakistan.
Musharraf’s troubles began in March when he suspended Supreme Court Justice Chaudhry on allegations of misconduct.
Critics accused him of trying to put pressure on the court not to block his re-election and Musharraf’s popularity plummeted as lawyers rallied to support the top judge.
In July, after a week-long siege, Musharraf ordered troops to storm the Red Mosque in Islamabad to crush a Taliban-style movement based there.
At least 105 people were killed in the raid and a wave of deadly militant attacks and suicide bombings followed.

Imran Khan says Musharraf should face death penalty

ISLAMABAD: Opposition politician and former cricketer Imran Khan said Saturday that President Pervez Musharraf has committed treason and should face the death penalty for declaring a state of emergency.
Imran Khan also called on the Pakistani people to resist Musharraf’s move and not to recognise the new chief justice appointed by the military ruler.
“He has committed high treason by negating the orders of the Supreme Court which bars him from taking any unconstitutional steps and by sending in troops after the Supreme Court decision,” Khan was quoted as saying.
“He is punishable by death.”
He continued to say, "I urge every Pakistani people not to recognise this collaborator chief justice.
“I urge the people, lawyers, civil society to resist this move by Musharraf. I urge lawyers to boycott the court proceedings.”

کیونکہ کچھ شدت پسند، انتہا پسند، دہشت گرد اور خود کش حملہ آور، جن کو گرفتار کیا گیا اور ان سے تفتیش کر جاری رہی تھی ان کو رہا کر دیا گیا۔ ان افراد کو جنہیں رہا کیا گیا بعد میں دہشت گردی کی کارروائیوں میں ملوث ہوئے جس کی وجہ سے انسانی جانوں اور املاک کا نقصان ہوا۔ ملک میں اس سے شدت پسندوں کے حوصلہ بلند ہوئے جبکہ قانون نافذ کرنے والے ادارے مایوسی کا شکار ہوئے۔
کیونکہ کچھ جج اپنے عدالتی اختیارات سے تجاوز کر رہے تھے اور انہوں نے انتظامیہ اور مقننہ کے اختیارات بھی اپنے ہاتھ میں لے لیے تھے۔
کیونکہ حکومت عدلیہ کی آزادی اور قانون کی بلادستی پر یقین رکھتی ہے اور اعلیٰ عدلیہ کی عزت کرتی ہے اس لیے یہ انتہائی اہمیت کی حامل ہے کہ اعلیٰ عدلیہ کے ارکان اپنے دائرہ اختیار میں رہیں اور انتظامیہ کے اختیارات اپنے ہاتھ میں نہ لیں۔
کیونکہ ایک اہم آئینی ادارہ، سپریم جوڈیشل کونسل ایک حالیہ حکم کی وجہ سے بلکل غیر متعلق اور غیر موثر ہو کر رہے گیا تھا اور ججوں نے اپنے آپ کو کسی انکوائری سے ماوورا بنا لیا ہے اور وہ احتساب سے مبرا ہو گئے تھے۔
کیونکہ اعلیٰ عدلیہ کے چند ارکان کی طرف سے سرکاری اہلکاروں سے مقدمات کی سماعت کے دوران مستقل انتہائی ہتک آمیز رویہ روا رکھا جا رہا تھا جس کی وجہ سے اعلی حکام اور نوکرشاہی کی حوصلہ شکنی ہوئی ہے اور وہ عدلیہ کی طرف سے ہراساں ہونے کے خوف سے کوئی اقدام نہیں اٹھا رہے تھے۔
کیونکہ ملک میں امن و اماں اور اقصتادی صورت حال متاثر ہوئی ہے اور اقتدارِ اعلیٰ کی تکون کمزور ہوئی ہے۔
کیونکہ ایسی صورت حال پیدا ہو گئی تھی جہاں پر حکومت آئین کے مطابق نہیں چلائی جا سکتی تھی جیسا کہ آئین اس صورت حال سے نبٹنے کے لیے کوئی حل پیش نہیں کرتا لہذا اس سے نکلنے کے لیے انتہائی اور ہنگامی اقدامات کے علاوہ کوئی راستہ نہیں تھا۔
اور جیسا کہ اس صورت حال پر وزیر اعظم اور چاروں صوبوں کے گورنروں اور چیئر مین جائنٹ چیف آف سٹاف کمیٹی، چیف آف آرمڈ فورسز، چیف آف آرمی اسٹاف اور پاک فوج کے کور کمانڈروں کے ساتھ اجلاسوں میں غور کیا گیا۔
اب اس غور خوص اور ان اجلاسوں میں لیے جانے فیصلوں کے تحت میں جنرل پرویز مشرف، چیف آف آرمی اسٹاف ملک بھر میں ایمرجنسی نافذ کرتا ہوں۔
میں حکم جاری کرتا ہوں کہ پاکستان کا آئین معطل رہے گا۔
اور یہ حکم ملک بھر میں فوری طور پر نافذ العمل ہو گ
We can see that it was not just about fanatics attacking military. This whole statement revolves around the Army’s dislike of supreme court justices. Fanaticism is only one part.
This statement shows that Army made things up to declare emergency. And Army occupied media because media would have shown to everyone that their actions are against the law of Pakistan.

good question. i think he made two mistakes. first was the agreement govt made with jihadis in wana. general ehsan pretty much acknowledged this in today's dawn. until that agreement, army had an upper hand against jehadis. this agreement gave breathing space to jehadis and allowed them to regroup. musharraf being the army chief has to take responsibilty for the failure of this strategy.
the other mistake musharraf made was on the political front. he could have gotten government to pass legislation against terrorism. legislation could have made harder for courts to give bail to jehadis. also laws could have been made to prevent media from glorifying jehadis. musharraf's government and all his ministers were asleep at the wheel and due to their incompetence, pak is paying a heavy price. if govt had anticipated the threats correctly, it could clipped the wings of courts and media with repect to the support these institution provide to jehadis. govt combined with ppp on hisba bill. legislation could have been passed with support of ppp against jehadis.
