****SLAMABAD: **New electoral rolls for the 2013 elections cannot be finalised before May this year, said Chief Election Commissioner Justice (retd) Hamid Ali Mirza on Monday.
**Mirza said that the responsibilities of every institution are chalked out clearly in the Constitution, and unnecessary interference of institutions results in anarchy. He added that the task of finalising new electoral rolls should remain with the ECP without interference from any institution.

He also said that if the electoral rolls were not finalised as per the law then it will be held against the Constitution.
In December last year, the Supreme Court ordered the commission to wrap up the process of finalising the electoral rolls and gave a final deadline of February 23. The order was handed out during the hearing of a petition filed by Pakistan Tehreek-e-Insaf Chairman Imran Khan, who had asked the court to remove fake votes from the electoral rolls.
The ECP in a statement had also admitted that some 37 million votes were bogus and could not be verified.

Stopping by-polls by SC unconstitutional, says ECE
**During a meeting of Election Commission of Pakistan, Chief Election Commissioner Justice (r) Hamid Ali Mirza said that voter lists could not be finalized till Feb 23 adding that conducting by-polls within stipulated time period was also responsibility of the Election Commission.
Earlier, the Supreme Court has ordered the ECP to complete the voter lists till February 23.

The ECE said that all the lists which would be prepared without fulfilling of legal requirements would be unconstitutional adding that if any institution would force to complete it soon, would also be responsible of mistakes in lists.

Moreover, addressing a news conference, Secretary Election Commission Ishtiaq Ahmad said that the commission was bound to arrange elections within 60 days.****He contended that the Supreme Court’s order to stop by-polls was clear violation of the constitution.

He said that preparation for voting list was started in 2009. Some elements are propagating that this work was started on the direction of any political force, he said. NADRA has assigned the duty to prepare voting lists which would issue final lists on May 25, he said.
He informed that next elections would be contested according to old constituencies. He said that the political parties would like to see the Election Commission powerful.

Even if every second vote is fake? Does it serve the purpose of balloting?
If constitution could be held in abeyance for a wrong purpose, why it can’t be violated for a good purpose? And I thought it was the Supreme Court to interpret constitution, but looks like it is actually the Secretary of Election Commission

I know the election commission is telling the supreme court that they are defying the constitution, on the other hand to hold elections on fake votes is constitutional? The election commission have admitted that around 40 million votes are fake which make up about half of total votes of the country.

simple solution, if they want to hold by-elections within 60 days, they should complete the on-going work of electoral rolls before that. SC is not stopping them from holding elections, rather SC asked them to hold elections on correct voter lists instead of the ones full of fake votes. why not put more people to work and get it done?
