I want to do.my theory test nd get a driving license however I havent been in.uk.for 185 days in the year as.the requirements, even though I am a uk cit.
So in the ID sections if I send.my birth cert and another form of ID not.my passport will.I be ok?
I sound dodgy but I’m.not applying for benefits I’m just doing.my.driving so if I sent other docs will.I be OK? Or will.they still.find a way to find out.my months of stay in uk for the last 2/3 years.
Please let me know if what I’m asking.for is a.massive fraud as well
Well yes, it is fraud and illegal since the rules clearly state you need to be residing in the UK for a minimum amount of time over a set period.
If you want to disregard that rule because you think it shouldn’t apply to you then that’s your decision, but you should also bear in mind that even passport details are stored electronically these days so even if you send another form of I.D instead doesn’t mean that it won’t be checked. Unless you know someone who works for the DVLA and can confirm otherwise.
Okay so curiosity got the better of me about this ruling and from what I’ve read online, you DO qualify to be able to book your theory test. That 185 day a year thing is for people who usually live in another EU country.
This is the extract you need to look at:
“Where you must live
You cannot take a test or get a full licence unless you are normally resident (live) in this country. This means you must work here (and pay tax) or have close family here. However, if you have moved to the UK from another European Union (EU) or European Economic Area (EEA) country, you should not take a driving test or get a first full licence unless you have lived here for 185 days in the last 12 months and are still living here at the time you apply for your licence. The test centre may ask you to provide evidence of this.”
Plus, what’s to say you haven’t moved back to the UK…you might have a return ticket but your intended return to Pakistan won’t be recorded on your passport even if they do check IYSWIM.
In that case, yes it’s too late to apply for this year. You should’ve booked it when you first arrived in the UK but I guess you can do it next time instead and revise for it in the meantime.
