No, they tried him because the FATA is governed by British-written laws (Frontier Crimes Regulations) that state that the punishment for treason is jail. If he was tried outside of the FATA, the only punishment that a judge can give for treason is execution under the Pakistan Criminal Code that exists in the rest of the country.

Thanks for bringing this difference in my notice. As far as ordinary courts are concerned I believe he might have been acquitted because of the evidence laws.
