"Aafia’s lawyers surprised many by not seeking bail

NEW YORK, Aug 12: That the lawyers representing Aafia Siddiqui, a Pakistani neuroscientist accused of attempting to kill an American soldier while in US custody in Afghanistan, did not seek her immediate release on bail by a New York Federal Court on Monday surprised most people here.

Instead of seeking bail, the lawyers asked the court to order immediate medical treatment for Ms Siddiqui who was in pain and suffering from injuries.

“She needs to be taken out of custody and put in a hospital. She’s been here... for one week and hasn’t seen a doctor,” Elizabeth Fink, her court appointed lawyer, said.

Highly informed sources here told Dawn that the defence lawyers had been told by the prosecuting US attorney’s office that the bail amount would be ‘huge and prohibitive’.

“Let me just say no amount of bail money would satisfy the US authorities who are convinced of Aafia’s Siddiqui’s guilt and have proof about her involvement in the Al Qaeda terror network and other illegal activities,” one officials here said on condition of anonymity.

Asked as to why she did not ask Magistrate Judge Robert Pitman to set her bail, Ms Fink who made an impassioned appeal for her immediate release last week, hedged the question suggesting “there was more to it than meets the eye”.

Ms Elaine Sharp, the Boston attorney hired by her family years ago similarly evaded the question when asked by a battery of reporters why the defence team did not press for Ms Siddiqui’s bail. “What’s the point of bail”, she said, adding her medical treatment was now the priority.

Ms Fink decried that her client had not received proper medical care since being shot in the alleged incident on July 18.

Ms Sharp said her client was a physical wreck following both the shooting and a five-year period of her disappearance. “She has gunshot wounds to the abdomen – we are not sure how many – and a long line of stitches from her breast plate to her belly button. She understands she lost part of her intestines. Digestion is an issue. She’s reporting bleeding.”

^ I believe if she is treated while in custody then the govt will pay for the treatment, while if she is bailed out (cost of which is prohibitively huge as per article) then they will have to get the treatment on their own, just my thought.


Where did you get this "mum about her time..."?

As time goes on, it is becoming more likely that she and her children were hiding with AlQaeda in Afghanistan/FATA.

Attorney mum on Aafia’s children whereabouts

NEW YORK, Aug 15: Elizabeth Fink, the attorney for Aafia Siddiqui, a Pakistani woman charged by the US authorities with trying to kill US soldiers in Afghanistan, says that Aafia was tortured but keeps quiet on the whereabouts her children.

“The woman has been tortured,” Ms Fink said. “I believed she has been tortured based on my experience with people with post-traumatic stress disorder.”

On the crucial question about the whereabouts of Ms Siddiqui’s three children whose custody is being sought by Pakistani authorities, Ms Fink refused to comment suggesting that some issues could not be shared with the press.

When Pakistani consular officers met Ms Siddiqui last Saturday another defence attorney, Gideon Oliver, asked Ms Siddiqui not to speak about her children.

Later talking to Dawn he confirmed that he had stopped Ms Siddiqui from revealing any information about her children to Pakistani authorities.

Pakistan’s Deputy Consul General Saqib Rauf also said that Ms Siddiqui wanted to speak about her children but was restrained under advice of her counsel. “She kept on asking after the welfare of her mother and wanted to know about the political conditions in the country”, he said.

Lets wait and see as what shows up later on this issue, if she truly ran and hid in Afghanistan then she must be AlQaida operative, may the truth come out in the open sooner than later and may justice prevail.

this indeed is sad , made me go numb...............nobody mentioned about her 3 kids nowhere in the news & articles , it's not just one but 4 lives r involved in this whole ordeal, i'm surprised that her husband didn't made any attempt to get to know about their kids , or may be he too is detained somewhere ?? allah reham karey

Her current husband (who is also a nephew of Khalid Sheikh Muhammad) is indeed in US custody. I beleive he was plotting some terrorist operation in US. She is divorced from the father of the three kids in question, I think he is in Karachi practicing medicine.

Her Children are in Afghanistan. They are all grown up.

I said it before and I say it again. Nobody took her children but her. ISI has no history of kidnapping young children.

There is a picture floating around the net that shows her and her oldest son. He appears to be 8 or 9 and he is wearing blue shalwar qameez. The picture was taken recently while she and the kids were in Afghanistan.

Another source mentioned that she has been making secret visits to Pakistan and meeting up with AQ sympathizers.

Off course Pakistani media would ignore all that and continue blaming Pakistan and America.

About ISI's history, I dont know what history are you talking about? ISI is an intelligence agency and none of the intelligence agencies have any principle or moral values to follow. They just do wutever they are supposed to do. No matter if its related with children of anyone or women or olders.

let's have an voice. What can they do? What do you fear? what about Amnesty International? Or are they sold, too? Even if she is was an Terrorist - God forbid - there is no need for what is going on now with her. Where are her kids?

Interestingly, she hasn’t been indicted for terrorism. The entire legal case against her is for allegedly trying to shoot american soldiers during her interrogation.

According to the indictment, Siddiqui faces one count of attempting to kill US nationals abroad; one count of attempting to kill US officers and employees; one count of armed assault of US officers and employees; one count of using and carrying a firearm during and in relation to a crime of violence; and three counts of assault of US officers and employees.

“If convicted, Siddiqui faces a maximum sentence of 20 years in prison on each of the attempted murder and armed assault charges; life in prison on the firearm charge; and eight years in prison on each of the remaining assault charges,” it said.

If she was truly innocent, the americans would have let her go. They have already released many from guantanomo bay.

Everything about her behavior is suspicious, the fact she married a senior al-queda member, the fact she left usa to go to afghanistan etc etc.

She is a scientist, could she have been in a long term sleeper agent? Maybe she was researching how to do some serious chemical/biological attacks on USA using her expertise?

I work in NYC and close to Times Square and I am in a prime target area for terrorist attack. So my belief is to be better safe than sorry.

After all the authentic proofs provided about her innocence by different sources, it is very sad to know that some people still think of such a possibility.
